【摘要】：創(chuàng)新是引領發(fā)展的第一動力,法治環(huán)境是創(chuàng)新的第一環(huán)境。軟法和硬法都是國家治理的重要工具,二者皆有不足,卻可互通有無,取長補短。法治環(huán)境是硬法治環(huán)境與軟法治環(huán)境的統(tǒng)一。加快實施創(chuàng)新驅(qū)動發(fā)展戰(zhàn)略,最根本的落腳點在法治建設,創(chuàng)造有利于創(chuàng)新的法治環(huán)境。要綜合運用硬法和軟法手段,“軟硬兼施”,方能發(fā)揮法治環(huán)境“第一”效應。就行政法來說,從行政訴訟到行政處罰,從行政指導到區(qū)域合作協(xié)議,都是可以好好運用的硬法與軟法資源。
[Abstract]:Innovation is the first motive force leading development, and the environment of rule of law is the first environment of innovation. Both soft law and hard law are important tools of national governance. The environment of rule of law is the unity of the environment of hard rule of law and the environment of soft rule of law. To speed up the implementation of the innovation-driven development strategy, the most fundamental point lies in the construction of the rule of law and the creation of a legal environment conducive to innovation. In order to exert the "first" effect of the legal environment, we should comprehensively use the hard and soft methods and "both the soft and hard methods" in order to exert the "first" effect in the environment of the rule of law. As far as administrative law is concerned, from administrative litigation to administrative punishment, from administrative guidance to regional cooperation agreement, are hard and soft law resources that can be used well.
