人類的各種實踐活動在總體上是屬人的,是為了人類各種各樣的需求與欲望,法治作為人類的政治實踐活動亦概莫能外。眾所共知,法治的根本目標(biāo)是保障人權(quán),但人權(quán)與人的需求與欲望有何關(guān)系即法治的保障人權(quán)目標(biāo)與法治的屬人性有何共通之處?另外,人類活動區(qū)別于動物活動之外正在于其充滿理性,那么,在人類的法治實踐活動中,人類的理性充當(dāng)?shù)挠质窃鯓拥慕巧?本文正是基于法治的屬人性,從人性的角度,通過對人的功欲與法治、人的理性與法治之間關(guān)系的探討,試圖對法治有一個更為深入的研究。本文除前言之外,共分為五部分,近40000字。 第一部分對現(xiàn)代法治的屬人性進(jìn)行分析。通過法治與法制、法治與人治的對比及對法治基本特征的分析,尋求現(xiàn)代法治與民主、人權(quán)、市場經(jīng)濟(jì)的關(guān)系,并最終明確現(xiàn)代法治與人的關(guān)系,即現(xiàn)代法治的屬人性。 第二部分對人性概念進(jìn)行界定;谥黧w偏見等客觀條件所限,對人的理解或?qū)θ诵愿拍畹慕缍ㄋ坪跏莻千古之謎,但因研究之需,又不能不對其有所界定,本部分通過對歷史的篩選與總結(jié),得出這樣一個結(jié)論:人性是功利與理性的復(fù)合。 第三部分從人的功利角度對法治進(jìn)行探討。由人的需要與欲望引致人類的經(jīng)濟(jì)行為,繼而是應(yīng)需而生的法治文明。因而,法治在最終目的上是為了人類的欲望與需求。 第四部分從人的理性角度對法治進(jìn)行分析。法治是人類惡欲相爭的結(jié)果,亦是人類理性思維的結(jié)晶;基于人類為求最大功欲而懼亂思安的理性反應(yīng)及由此而來對理性的崇拜與向往,法治的理性本質(zhì)使其最終成為人類治理規(guī)則的理想選擇。 第五部分對人類感性需求向法治理性規(guī)則的質(zhì)變進(jìn)行探索,并對中國法治建設(shè)過程中存在的問題進(jìn)行檢討。人類感性需求向法治理性規(guī)則質(zhì)變的實踐方式是人類的民主活動,人類感性需求向法治理性規(guī)則質(zhì)變的邏輯中介是人權(quán)概念。中國法治建設(shè)過程中存在的問題總的來說表現(xiàn)為兩個二極分化。
All activities of man, which are for meeting people"s all kinds of demands and desires, are humanistic, and as one kind of human political practise, Rule by law could not be exceptional. As understanding generally, the ultimate objective of Rule by law is to secure human rights, then is there any relationship between the aforesaid ultimate objective and people"s demands and desires, or is there any common ground between the aforesaid ultimate objective and humanity of Rule by law? Otherwise, it is to have nous that makes people different from animals. And what role does the nous play in human activities? Based on humanity of Rule by law, the author try to deeply study the Rule by law through probing in the relation between human desires and Rule by law , and in relation between human nous and Rule by law. Subject to preface, there are five parts and about 40000 words in the article.Part One analyzes humanity of contemporary conception of Rule by law. Comparing Rule by law with Legal system and Rule by men, and analyzing basic characteristics of Rule by law, the author tries to find out the relationship among Rule by law and democracy, human rights, market economy, that is to say, to find out humanity of Rule by law.Part Two is about how to understand the humanity. It is a mystery that what the humanity is under the impersonal conditions. Provided that the humanity must be defined for the studying of Rule by law. Selecting and concluding from history , a conclusion is elicited in this part -humanity is the compound of utility and nous.Part Three discusses Rule by law from the point of view of humanity. Because of people"s demands and desires, economic activities happens, and that makes the civilization of Rule by law come into being. Then the ultima aim of Rule by law is to satisfypeople"s desires and demands.Part Four discusses Rule by law from the point of view of nous. Rule by law is the result of contest of evils and desires, and the fruit of human nous. On the ground of rational reflection to pursue the largest desires and of the adoration and yearning to nous, Rule by law becomes the perfect selection from human rules.Part Five explores the qualitative change from human geist to rational rules of Rule by law, and reviews the questions existing in Chinese legal construction. The practicing mode of the aforesaid qualitative change is human democratic activities, and the logical resonance is the conception of human rights. In Chinese legal construction, existing questions show ambipolar polarization.
