【摘要】：在法治國(guó)家、法治政府、法治社會(huì)一體化建設(shè)進(jìn)程中,社會(huì)治理創(chuàng)新的內(nèi)在邏輯是推進(jìn)國(guó)家治理體系和治理能力現(xiàn)代化。以現(xiàn)代行政過程為分析基礎(chǔ)、以有限行政和有效行政為分析原點(diǎn)的政府法治論,是建構(gòu)社會(huì)治理體系的基礎(chǔ)。"依法律善治"既是政府法治論的核心內(nèi)容,也是政府推進(jìn)社會(huì)治理創(chuàng)新的應(yīng)然選擇。推進(jìn)政府行政體制改革、促進(jìn)政府職能轉(zhuǎn)變、健全政府責(zé)任體系、構(gòu)建非政府組織參與機(jī)制等是政府"依法律善治"的有效路徑。
[Abstract]:In the process of the country ruled by law, the government under the rule of law and the society under the rule of law, the internal logic of the innovation of social governance is to promote the modernization of the national governance system and governance capacity. The theory of government rule of law, which takes the modern administrative process as the analysis basis and the limited administration and the effective administration as the origin, is the foundation of the construction of the social governance system. " Good governance according to law is not only the core content of the government's rule of law theory, but also the necessary choice for the government to promote the innovation of social governance. Promoting the reform of government administrative system, promoting the transformation of government functions, perfecting the government responsibility system, and constructing the participation mechanism of non-governmental organizations are the effective ways for the government to "govern according to the law".
