【摘要】：關(guān)于尊嚴概念的規(guī)范性,目前學(xué)界存在四種主要的質(zhì)疑觀點。通過語用分析可以發(fā)現(xiàn)尊嚴概念是一個具有多重規(guī)范性的觀念集合,是人類從不同視角對自我的理解和認同。在由"個體—共同體"和"先天—后天"兩個向度構(gòu)成的坐標上,存在著基于權(quán)威的尊嚴、基于理性的尊嚴、基于德行的尊嚴和基于傳統(tǒng)的尊嚴等四種觀念類型,它們分別在各自語境下?lián)碛刑囟ǖ囊?guī)范性內(nèi)涵。尊嚴概念與法治理論密切相關(guān),形式合法性的法治觀與基于理性的尊嚴觀具有親和關(guān)系,實質(zhì)合法性的法治觀是尊嚴諸觀念協(xié)同作用的結(jié)果。
[Abstract]:On the normative concept of dignity, there are four main doubts in academic circles. Through pragmatic analysis, we can find that the concept of dignity is a multi-normative set of concepts, which is the human understanding and recognition of self from different perspectives. In the coordinate system composed of "individual community" and "innate and acquired" dimensions, there are four kinds of concept types: dignity based on authority, dignity based on reason, dignity based on virtue and dignity based on tradition. They have specific normative connotations in their respective contexts. The concept of dignity is closely related to the theory of the rule of law.
