地方黨政關(guān)系法治化研究

【摘要】: 當(dāng)代中國(guó),政治體制改革的重要性日漸凸顯,而政治體制中深層次的矛盾,即黨政關(guān)系矛盾就是這場(chǎng)改革所要面臨的最核心的問(wèn)題。地方政府作為中國(guó)改革開(kāi)放、發(fā)展民生的最根本的政權(quán)單位,地方黨政關(guān)系的規(guī)范化、法制化問(wèn)題越來(lái)越受到政治家和學(xué)者的重視,究竟怎樣才能從根本上解決地方黨委與地方政府的沖突,筆者認(rèn)為,從國(guó)際經(jīng)驗(yàn)和中國(guó)的現(xiàn)實(shí)來(lái)看,唯有實(shí)現(xiàn)地方黨政關(guān)系的法治化,尋找一條適合中國(guó)各地方情況的法治化改革路徑才能最終打破黨政關(guān)系非法治化運(yùn)行的怪圈。 筆者認(rèn)為,實(shí)現(xiàn)地方黨政關(guān)系法治化,不能僅僅著眼于地方黨委與地方政府之間的關(guān)系。必須采取綜合的視角,三百六十度地全面審視地方黨政關(guān)系所面臨的政治生態(tài),從地方黨委組織,包括地方黨代會(huì)、地方黨委會(huì)、地方常委會(huì)三級(jí)地方黨的組織自身管理出發(fā),在這個(gè)基點(diǎn)上,審視地方黨委與地方行政機(jī)關(guān)、地方人大、地方政協(xié)等多元政權(quán)主體之間的法治化路徑。 地方黨政關(guān)系法治化路徑選擇,這個(gè)命題的最終目的與意義是為了在新的歷史時(shí)期提高黨的執(zhí)政能力,改革與完善地方黨委的執(zhí)政方式與領(lǐng)導(dǎo)水平,最高宗旨就是實(shí)現(xiàn)地方黨委代表本地區(qū)最廣大人民群眾的根本利益,地方政府合法、充分地行使各項(xiàng)職能,趨向服務(wù)型地方政府的構(gòu)建。
[Abstract]:In contemporary China, the importance of political system reform is becoming more and more prominent, and the deep-seated contradiction in the political system, that is, the contradiction between the Party and the government, is the core problem to be faced with in this reform. As the most fundamental unit of political power in China's reform and opening up and development of the people's livelihood, local governments have paid more and more attention to the standardization and legalization of local party-government relations. How can we fundamentally resolve the conflict between local party committees and local governments? the author believes that from the international experience and the reality of China, it is only possible to realize the rule of law in local party-government relations. Only by seeking a path of legalization reform suitable for the local conditions in China can we finally break the strange circle of the non-legalized operation of the relationship between the Party and the government. The author believes that the relationship between the local party committee and the local government should not only be focused on to realize the legalization of the relationship between the local party and government. We must adopt a comprehensive perspective and comprehensively examine the political ecology faced by local party-government relations at 360 degrees. Starting from the management of local party committee organizations, including local party congresses, local party committees, and local standing committees, local party organizations at three levels are responsible for their own management. On this basis, we should examine the rule of law between the local party committee and the local administrative organs, the local people's congresses, the local CPPCC and other pluralistic regime subjects. The ultimate purpose and significance of this proposition is to improve the ruling ability of the Party in the new historical period, and to reform and perfect the ruling mode and leadership level of the local party committees. The supreme aim is to realize the fundamental interests of the local party committee representing the vast majority of the people in the region, the local government legally and fully performing all its functions, and towards the construction of the service-oriented local government.
