【摘要】： 列寧建設社會主義法治國家的構(gòu)想是他在領導俄國社會主義革命和社會主義建設的實踐過程中形成和發(fā)展起來的,馬克思、恩格斯的法律思想是其理論起點。列寧雖然沒有系統(tǒng)地闡述其法治國家構(gòu)想,但是他建設社會主義法治國家的一些觀點是散見于其他起草的各種文件以及其著作中的,筆者通過重讀列寧的作品,結(jié)合現(xiàn)階段有關(guān)學術(shù)研究成果,系統(tǒng)地總結(jié)出列寧建設社會主義法治國家的構(gòu)想,這對于現(xiàn)階段我國建設社會主義法治國家的實踐具有重要的理論指導意義。本文主要通過歷史分析法、文獻解讀法、歸納總結(jié)法最終總結(jié)出列寧建設社會主義法治國家構(gòu)想的四大框架:加強立法,構(gòu)建完備的法律體系思想及其實踐探索;保障人權(quán),構(gòu)建人權(quán)保障制度思想及其實踐探索;建立有效的權(quán)力制約機制、監(jiān)督機制思想及其實踐探索;正確處理黨法關(guān)系思想及其實踐探索。本文通過對這四部分的系統(tǒng)闡釋,并此框架內(nèi)聯(lián)系我國建設社會主義法治國家的實踐探索,揭示出列寧關(guān)于建設社會主義法治國家構(gòu)想的理論意義及其當代價值。這也正是本文研究的出發(fā)點和最終歸屬。
[Abstract]:Lenin's conception of building a socialist country ruled by law was formed and developed in the course of his practice of leading the Russian socialist revolution and socialist construction. Marx's and Engels' legal thoughts were the starting point of his theory. Although Lenin did not systematically elaborate his idea of a state ruled by law, some of his views on building a socialist country ruled by law were scattered in other drafting documents and his works. The author read Lenin's works again. Based on the current academic research results, this paper systematically summarizes Lenin's conception of building a socialist country ruled by law, which is of great theoretical significance to the practice of building a socialist country ruled by law in our country at the present stage. This article mainly through the historical analysis method, the literature interpretation method, the induction summary law finally summarizes Lenin to construct the socialist rule of law country idea four big frame: strengthens the legislation, constructs the complete legal system thought and the practice exploration, guarantees the human rights, To construct the human rights guarantee system and its practical exploration, to establish an effective power restriction mechanism, to supervise the mechanism and to explore its practice, and to correctly deal with the relationship between the Party and the law and its practice. Through the systematic explanation of these four parts and the practical exploration of building a socialist country ruled by law in China within this framework, this paper reveals the theoretical significance and contemporary value of Lenin's conception of building a socialist country ruled by law. This is the starting point and ultimate ownership of this study.
