【摘要】："圣諭宣講"是清代統(tǒng)治者宣揚(yáng)統(tǒng)治思想,統(tǒng)一社會(huì)秩序的一項(xiàng)重要措施。順治年間,為加對(duì)大云南武定彝族那氏土司地區(qū)的社會(huì)控制,清政府令地方官員將"圣諭六條"及宣講內(nèi)容寫入"鄉(xiāng)規(guī)全書",令專人定期宣講,作為當(dāng)?shù)刈罡咝袨闇?zhǔn)則和治理規(guī)范。圣諭宣講以"禮法結(jié)合""出禮入刑"的傳統(tǒng)法律思想為核心,利用大清律法的嚴(yán)酷維護(hù)圣諭威嚴(yán),震懾鄉(xiāng)民使其不敢逾越禮教,無形中加深了鄉(xiāng)民對(duì)大清律法精神和內(nèi)容的認(rèn)識(shí)。從這一角度看,圣諭宣講以宣揚(yáng)禮教之形式,得法律教育之實(shí)效,是清王朝對(duì)少數(shù)民族地方推行國家法律的重要手段,是清代中央對(duì)少數(shù)民族地方實(shí)行"法制統(tǒng)一"的思想原則的的反映,同時(shí),宣講活動(dòng)在形式和內(nèi)容上表現(xiàn)出的對(duì)少數(shù)民族傳統(tǒng)權(quán)威以及文化的重視,也反映清統(tǒng)治思想中"以民治民"、靈活變通的法律思想。
[Abstract]:"Oracle Propaganda" was an important measure for the rulers of the Qing Dynasty to propagate the ruling ideology and unify the social order. During Shunzhi reign, in order to strengthen the social control over the Na's Tusi area in Wuding, Yunnan Province, the Qing government ordered local officials to write the "Six Articles of Oracle" and the contents of the propaganda into the "Rural Regulations" and ordered special people to propagate regularly as the highest local code of conduct. The Oracle propaganda takes the traditional legal thought of "combining rites with law" and "going out of rites and putting into punishment" as the core, uses the Qing Dynasty law to safeguard the oracle's dignity, deters the villagers to dare not surmount the rites and teachings, and invisibly deepens the villagers'understanding of the spirit and content of the Qing Dynasty law. The actual effect of legal education was an important means for the Qing Dynasty to carry out national laws in ethnic minority areas and a reflection of the central government's ideological principle of "unification of legal system" in ethnic minority areas. At the same time, the propaganda activities showed emphasis on the traditional authority and culture of ethnic minorities in form and content, and also reflected the Qing ruling ideology. "The rule of the people by the people" is flexible and flexible.
