【摘要】：依法治國是社會(huì)主義現(xiàn)代化建設(shè)的基本保證,《中華人民共和國憲法》明確將“以法治國”作為治國方略,是對全體公民提出的基本要求。高校作為教育教學(xué)、培養(yǎng)人才、服務(wù)社會(huì)的主陣地,承擔(dān)著為社會(huì)建設(shè)和經(jīng)濟(jì)發(fā)展造就一批又一批的合格建設(shè)者的重任,其法制教育的實(shí)效與成功,直接影響國民的整體素質(zhì)。我國高校法制教育自改革開放以來,取得了一定的成果,但對法制教育的重要性還存在著模糊的認(rèn)識,其理念較為陳舊。在教學(xué)上,形式重于實(shí)效,由此造成了知識與生活的分界。其原因的復(fù)雜性使得重塑法制教育理念、實(shí)現(xiàn)法制教育理念的現(xiàn)代化是當(dāng)前高校法制教育及社會(huì)合格人才培養(yǎng)的客觀選擇。法制教育理念是人們居于一定的物質(zhì)客觀性,對法制教育的一種主觀認(rèn)識,能夠指導(dǎo)法制教育實(shí)踐的運(yùn)行。中國的法制教育脫胎于傳統(tǒng)的法制觀念,因而其理念的現(xiàn)代化典型地表現(xiàn)為“沖擊一反應(yīng)”型。我國高校法制教育隨著“和諧社會(huì)”的提出,關(guān)于法制教育理念的探究也逐步走向深入,在教育教學(xué)實(shí)際中,主要表現(xiàn)為：高校法制教育愈益受到關(guān)注；大學(xué)生的法制意識明顯增強(qiáng)；由理論的學(xué)習(xí)走向?qū)嵺`的運(yùn)用,法制教育開始關(guān)注學(xué)生生活。但法制教育的現(xiàn)實(shí)不容回避,其理念的重塑任重而道遠(yuǎn),其現(xiàn)代化過程還需要解決其間的種種矛盾,就此而言,我國高校的法制教育理念的培育應(yīng)從以下方面入手：向國外學(xué)習(xí),加強(qiáng)法制信仰的培育；進(jìn)一步明確高校辦學(xué)理念,為高校法制教育理念現(xiàn)化提供理論保障；優(yōu)化教師知識結(jié)構(gòu),為高校法制教育理念現(xiàn)代化提供知識支撐；明確法制教育法律文化的創(chuàng)造使命；擴(kuò)張法制教育的法制社會(huì)化功能；增強(qiáng)學(xué)生家長的法制意識,為高校法制教育理念現(xiàn)代化創(chuàng)造良好的社會(huì)環(huán)境。
[Abstract]:Ruling the country according to law is the basic guarantee of socialist modernization, and the Constitution of the people's Republic of China explicitly regards "ruling the country by law" as the general plan of governing the country, which is a basic requirement for all citizens. As the main position of education and teaching, training talents and serving the society, colleges and universities undertake the important task of bringing up a number of qualified constructors for social construction and economic development. The effectiveness and success of legal education directly affect the overall quality of the people. Since the reform and opening up to the outside world, legal education in colleges and universities in China has made some achievements, but there is still a vague understanding of the importance of legal education, and its concept is relatively old. In the teaching, the form is more important than the actual effect, has caused the boundary between the knowledge and the life. The complexity of the reasons makes it an objective choice to remould the legal education idea and realize the modernization of the legal education idea in current colleges and universities as well as the training of qualified social talents. The concept of legal education is that people live in a certain material objectivity, a kind of subjective understanding of legal education, can guide the operation of legal education practice. Chinese legal education is born out of the traditional concept of legal system, so its modernization is typically characterized by "shock-reaction" type. With the development of "harmonious society", the research on the concept of legal education in colleges and universities in our country has gradually gone deeper. In the practice of education and teaching, the main manifestations are: the legal education in colleges and universities is paid more and more attention to; The legal consciousness of college students is obviously strengthened, and from the study of theory to the application of practice, the education of legal system begins to pay attention to the life of students. However, the reality of legal education cannot be avoided, the remolding of its concept is a heavy task, and the process of its modernization still needs to resolve all kinds of contradictions. The cultivation of the idea of legal education in colleges and universities in our country should start from the following aspects: to study abroad, to strengthen the cultivation of legal belief, to further clarify the idea of running a school in colleges and universities, to provide theoretical guarantee for the realization of the idea of legal education in colleges and universities; To optimize teachers' knowledge structure, to provide knowledge support for the modernization of the concept of legal education in colleges and universities, to make clear the mission of creating legal culture of legal education, to expand the function of legal socialization of legal education, to strengthen the legal consciousness of students' parents, To create a good social environment for the modernization of the concept of legal education in colleges and universities.
