【摘要】：就政治資源的控制而言,大致分為權(quán)力制衡機(jī)制和權(quán)力監(jiān)督機(jī)制兩種。民主法治先行的西方國(guó)家較多采用權(quán)力制衡機(jī)制。中國(guó)人大監(jiān)督制度的控權(quán)機(jī)制是權(quán)力監(jiān)督而不是權(quán)力制衡,權(quán)力監(jiān)督是憲法設(shè)定的控權(quán)機(jī)制。要疏通和拓展人民群眾對(duì)人大及其代表進(jìn)行監(jiān)督的渠道,加強(qiáng)各級(jí)人大對(duì)"一府兩院"的監(jiān)督工作,探索建立適合國(guó)情的憲法監(jiān)督制度,切實(shí)加強(qiáng)人大代表隊(duì)伍的建設(shè)。如此,才能開(kāi)啟人大發(fā)展與時(shí)俱進(jìn)的機(jī)遇期。
[Abstract]:As far as the control of political resources is concerned, it can be divided into two types: power balance mechanism and power supervision mechanism. Western countries with democracy and the rule of law are more likely to adopt power checks and balances. The power control mechanism of the supervision system of Chinese people's Congress is power supervision, not power check and balance, and power supervision is constitutionally established power control mechanism. It is necessary to dredge and expand the channels for the masses to exercise supervision over the people's Congress and its deputies, strengthen the supervision work of the people's congresses at all levels over "one government, two courts," explore and establish a constitutional supervision system suitable to the national conditions, and conscientiously strengthen the building of the contingent of deputies to the people's Congress. Only in this way can we open the period of opportunity for the development of the people's Congress to keep pace with the times.
