【摘要】：隨著我國(guó)推進(jìn)宏觀調(diào)控目標(biāo)制定和政策手段運(yùn)用機(jī)制化,中央銀行窗口指導(dǎo)的法律地位將逐步提升,并將成為我國(guó)貨幣政策法定工具之一。窗口指導(dǎo)是各國(guó)中央銀行普遍使用的貨幣政策工具,在20世紀(jì)80年代,窗口指導(dǎo)與公開(kāi)市場(chǎng)業(yè)務(wù)結(jié)合,形成公告操作、中央銀行溝通等更具現(xiàn)代意義的窗口指導(dǎo)形態(tài)。傳統(tǒng)形態(tài)的窗口指導(dǎo)屬于行政指導(dǎo),為非強(qiáng)制性行政法律行為,現(xiàn)代形態(tài)的窗口指導(dǎo)為非強(qiáng)制性行政事實(shí)行為。我國(guó)應(yīng)當(dāng)推進(jìn)中國(guó)人民銀行窗口指導(dǎo)的法制化,明確窗口指導(dǎo)的法律定位,強(qiáng)化與之對(duì)應(yīng)的金融機(jī)構(gòu)社會(huì)責(zé)任,建立以貨幣政策透明化為基礎(chǔ)的窗口指導(dǎo)法規(guī)體系。
[Abstract]:With the development of macro-control target and the application of policy means in China, the legal status of the central bank window will be gradually promoted, and will become one of the legal tools of monetary policy in our country. Window guidance is a monetary policy tool widely used by the central banks of various countries. In the 1980s, window guidance combined with open market business formed a more modern window guidance form such as announcement operation, central bank communication and so on. The traditional form of window guidance belongs to the administrative guidance, which is non-mandatory administrative legal act, and the modern form of window guidance is non-mandatory administrative factual behavior. China should promote the legalization of the window guidance of the people's Bank of China, clarify the legal orientation of the window guidance, strengthen the corresponding social responsibility of the financial institutions, and establish a window guidance law system based on the transparency of monetary policy.
