【摘要】：網(wǎng)絡(luò)民主參與是當(dāng)今民主的重要發(fā)展趨勢(shì)和時(shí)代特征。在從大眾民主、精英民主向協(xié)商民主的演進(jìn)過(guò)程中,網(wǎng)絡(luò)民主參與一方面能夠抑制“政治冷漠”和“參與難題”,從而強(qiáng)化公民意識(shí)和公共精神,擴(kuò)大民主范圍和增進(jìn)民主深度；另一方面,網(wǎng)絡(luò)民主參與也創(chuàng)造了一個(gè)“民間治理”的公共空間,促進(jìn)了自生自發(fā)秩序的形成,并成為民主法治進(jìn)程的新興動(dòng)力。然而,我們也應(yīng)看到,由于網(wǎng)絡(luò)空間的匿名性、即時(shí)性、流動(dòng)性、多元性、自由性等特有屬性,加之文化傳統(tǒng)、文明程度和國(guó)民素質(zhì)等錯(cuò)綜復(fù)雜因素的影響,也會(huì)出現(xiàn)諸如“網(wǎng)絡(luò)水軍”、“策劃炒作”、等非理性行為,某種程度上出現(xiàn)了民主風(fēng)險(xiǎn)性,甚至?xí){民主進(jìn)程和法治秩序。因此,弘揚(yáng)網(wǎng)絡(luò)民主參與的積極功能,抑制其不良傾向,加強(qiáng)對(duì)其相應(yīng)的法律規(guī)制也就成為一種必然的選擇。本文立足當(dāng)代民主的發(fā)展趨勢(shì)和中國(guó)的法治訴求,對(duì)網(wǎng)絡(luò)民主參與的法律規(guī)制方式進(jìn)行了分析和探索,以期為推進(jìn)網(wǎng)絡(luò)民主參與的民主法治功能作出一些學(xué)術(shù)努力。
[Abstract]:The network democratic participation is the important development trend and the time characteristic of today's democracy. In the process of evolution from popular democracy, elite democracy to consultative democracy, on the one hand, network democratic participation can restrain "political apathy" and "participation problem", thus strengthening the civic consciousness and public spirit. On the other hand, network democratic participation also creates a public space of "civil governance", promotes the formation of spontaneous order and becomes a new motive force in the process of democracy and rule by law. However, we should also see that due to the unique attributes of anonymity, immediacy, mobility, pluralism and freedom in cyberspace, as well as the complex factors such as cultural tradition, the degree of civilization and the quality of the people, There will also be irrational actions such as "cyber army", "planning speculation", and so on. To some extent, there will be a risk of democracy, and even a threat to the democratic process and the order of the rule of law. Therefore, it is an inevitable choice to carry forward the positive function of network democratic participation, to restrain its bad tendency and to strengthen its corresponding legal regulation. Based on the development trend of contemporary democracy and the demand of rule of law in China, this paper analyzes and explores the legal regulation of network democratic participation in order to make some academic efforts to promote the democratic and legal function of network democratic participation.
