論我國行政監(jiān)察法制的完善

【摘要】: 行政監(jiān)察法制就是國家行政機(jī)構(gòu)內(nèi)專門行使監(jiān)督職權(quán)的機(jī)關(guān),依法對(duì)國家行政機(jī)關(guān)、國家公務(wù)員行使行政權(quán)力的行為進(jìn)行監(jiān)督的制度!吨腥A人民共和國行政監(jiān)察法》與《中華人民共和國行政監(jiān)察法實(shí)施條例》的頒布實(shí)施,構(gòu)成行政監(jiān)察法制運(yùn)行的直接法律依據(jù)。以上述兩部法律法規(guī)為主體構(gòu)成的我國行政監(jiān)察法制,在實(shí)際監(jiān)察工作中取得了一定的成果,但是其還有不完善之處,主要表現(xiàn)在:內(nèi)容不完整;體系不完善;規(guī)定不明確;正是由于上述立法方面的不足,導(dǎo)致我國行政監(jiān)察法制在實(shí)際運(yùn)行中,面臨著許多問題。比如:行政監(jiān)察機(jī)關(guān)缺乏權(quán)威性和獨(dú)立性;行政監(jiān)察程序缺乏;行政監(jiān)察機(jī)關(guān)得不到有效監(jiān)督;行政監(jiān)察協(xié)調(diào)機(jī)制不完善;行政監(jiān)察人員執(zhí)法責(zé)任不完善等。造成我國行政監(jiān)察法制不完善的原因是多方面的,主要有文化因素、經(jīng)濟(jì)因素、制度因素,F(xiàn)代行政監(jiān)察制度起源于國外,距今已有上百年歷史,至今主要有三種行政監(jiān)察模式,一是政府行政管理模式,一是議會(huì)行政監(jiān)察模式,一是廉政監(jiān)察模式。我國應(yīng)該在借鑒這三種模式優(yōu)點(diǎn)的基礎(chǔ)上建立適合我國國情的行政監(jiān)察。完善我國行政監(jiān)察法制,可以從三大方面入手:完善行政監(jiān)察立法的內(nèi)容;健全立法體系;加強(qiáng)行政監(jiān)察機(jī)關(guān)的監(jiān)督機(jī)制。具體而言,應(yīng)當(dāng)明確行政監(jiān)察機(jī)關(guān)的權(quán)限,明確行政監(jiān)察的對(duì)象范圍,確立行政監(jiān)察活動(dòng)應(yīng)當(dāng)遵循的法定程序;完善行政監(jiān)察方面的配套法律法規(guī)的制定,確立我國的行政監(jiān)察專員制度,建立行政監(jiān)察機(jī)關(guān)同其它國家機(jī)關(guān)之間的協(xié)調(diào)機(jī)制;實(shí)行監(jiān)察人員責(zé)任追究機(jī)制,加強(qiáng)行政監(jiān)察機(jī)關(guān)的內(nèi)部監(jiān)督,健全相對(duì)人的權(quán)利救濟(jì)機(jī)制。
[Abstract]:The administrative supervision law system refers to the organs that exercise supervision functions and powers within the state administrative organs, and the administrative organs of the state shall, according to law, The system of supervision over the exercise of administrative powers by state civil servants. The promulgation and implementation of the Administrative Supervision Law of the people's Republic of China and the regulations on the implementation of the Administrative Supervision Law of the people's Republic of China, It constitutes the direct legal basis for the operation of the administrative supervision law system. The administrative supervision law system, which is composed of the above two laws and regulations, has made some achievements in the actual supervision work, but it still has some imperfections, mainly in the following aspects: the content is incomplete, the system is not perfect, the regulation is not clear; Because of the deficiency of the above legislation, the administrative supervision law system in our country is faced with many problems in practice. For example: the administrative supervision organ lacks authority and independence; the administrative supervision procedure lacks; the administrative supervision organ can not get the effective supervision; the administrative supervision coordination mechanism is not perfect; the administrative supervisor's law enforcement responsibility is not perfect and so on. There are many reasons for the imperfection of administrative supervision law system in our country, including cultural factor, economic factor and system factor. The modern administrative supervision system originates from foreign countries and has a history of more than a hundred years. There are mainly three administrative supervision modes up to now, one is the mode of government administration, the other is the mode of parliamentary administrative supervision, the other is the mode of clean government supervision. On the basis of using the advantages of these three models for reference, our country should establish administrative supervision suitable for our national conditions. To perfect the law system of administrative supervision in our country, we can start from three aspects: perfecting the content of administrative supervision legislation, perfecting the legislative system and strengthening the supervision mechanism of administrative supervision organs. In particular, the authority of the administrative supervisory organ should be clearly defined, the scope of the object of administrative supervision should be clearly defined, the legal procedures to be followed by the administrative supervision activities should be established, and the formulation of supporting laws and regulations on administrative supervision should be perfected. We should establish the system of administrative supervisors, establish the coordination mechanism between administrative supervisory organs and other state organs, carry out the mechanism of investigating the responsibility of supervisors, strengthen the internal supervision of administrative supervisory organs, and perfect the relief mechanism of the rights of the relative parties.
