【摘要】：我國期貨市場法制在交易者保護、操縱行為規(guī)制、異常交易行為處置、強制減倉等方面有待完善。關(guān)于交易者保護,建議建立系統(tǒng)的期貨交易者分類和適當(dāng)性制度;細(xì)化期貨經(jīng)紀(jì)機構(gòu)對交易者的保護責(zé)任,健全交易者爭議解決機制;加強期貨市場監(jiān)管協(xié)調(diào)和違法違規(guī)行為打擊力度,完善期貨違法違規(guī)行為民事責(zé)任制度,在期貨立法中單立"交易者保護"一章。關(guān)于操縱行為規(guī)制,建議強化期貨監(jiān)管機構(gòu)執(zhí)法權(quán)限,提高執(zhí)法效果;建立一個適應(yīng)我國期貨市場特點、定位明確、分工合理的期貨操縱監(jiān)管執(zhí)法機制,加強市場監(jiān)控,防范期貨市場操縱行為。關(guān)于異常交易行為處置,建議通過期貨立法規(guī)范異常交易行為,提升效力層級,賦予交易所處置異常交易行為權(quán)限和法律依據(jù)。關(guān)于強制減倉制度,建議通過期貨立法規(guī)范強制減倉,提升效力層級;監(jiān)管部門審慎使用強制減倉制度;期貨立法設(shè)計充分考慮各方利益平衡等。
[Abstract]:The legal system of futures market in China needs to be improved in the aspects of trader protection, manipulation behavior regulation, abnormal trading behavior disposal and compulsory reduction of position. On the protection of traders, it is suggested to establish a systematic system of classification and appropriateness of futures traders, to refine the duty of futures brokers to protect traders, and to perfect the dispute resolution mechanism of traders. Strengthening the coordination of futures market supervision and cracking down on illegal and illegal actions, perfecting the civil liability system of futures illegal and illegal acts, and setting up a single chapter on "Protection of traders" in futures legislation. With regard to the regulation of manipulation, it is suggested that the enforcement authority of futures regulatory bodies should be strengthened, and the enforcement effect should be improved, and a mechanism of futures manipulation and enforcement should be established that adapts to the characteristics of China's futures market, has a clear orientation and a reasonable division of labor, and strengthen market monitoring. Guard against futures market manipulation. On the disposal of abnormal trading behavior, it is suggested to regulate abnormal trading behavior through futures legislation, enhance the level of effectiveness, and endow the exchange with the authority and legal basis to deal with abnormal trading behavior. Regarding the system of compulsory reduction of positions, it is suggested that the compulsory reduction of positions be regulated by futures legislation to enhance the level of effectiveness; the regulatory authorities carefully use the system of compulsory reduction of positions; and the design of futures legislation should take full account of the balance of interests of all parties and so on.
