【摘要】：廣西北部灣經(jīng)濟(jì)區(qū)于2008年1月正式上升為國家戰(zhàn)略,它是國家批準(zhǔn)的第五個(gè)綜合配套改革試驗(yàn)區(qū),同時(shí)又是全國唯一具備國際區(qū)域經(jīng)濟(jì)合作功能的綜合配套改革試驗(yàn)區(qū)。它的開放開發(fā)不僅關(guān)乎廣西的發(fā)展,更能刺激西部地區(qū)的經(jīng)濟(jì)騰飛,對國家的經(jīng)濟(jì)協(xié)調(diào)發(fā)展也有著重大的意義。因此,經(jīng)濟(jì)區(qū)從成立至今,受到了各方的關(guān)注,也獲得了許多的支持。本文在闡述選題的背景和意義并對文章進(jìn)行了定義后,介紹了北部灣經(jīng)濟(jì)區(qū)的形成過程并對經(jīng)濟(jì)區(qū)的優(yōu)勢及特點(diǎn)進(jìn)行了分析。同時(shí),由于經(jīng)濟(jì)區(qū)的“經(jīng)濟(jì)區(qū)”和“綜合配套改革試驗(yàn)區(qū)”的雙重屬性,文章也用一定的篇幅對此進(jìn)行的剖析,旨在理清屬性關(guān)系,為下文做鋪墊。法制現(xiàn)狀的分析是法制建設(shè)問題研究的基礎(chǔ),因此,筆者從《廣西北部灣經(jīng)濟(jì)區(qū)條例》這一地方性法規(guī)入手,兼顧作為立法準(zhǔn)備的國家及自治區(qū)地方的促進(jìn)政策等,對經(jīng)濟(jì)區(qū)的現(xiàn)有法制作了分析。在指出現(xiàn)存法制的幾點(diǎn)不足后,歸納了國外一些國家進(jìn)行區(qū)域經(jīng)濟(jì)開發(fā),以及國內(nèi)其他綜合配套改革試驗(yàn)區(qū)在改革和發(fā)展過程中的有益經(jīng)驗(yàn),針對經(jīng)濟(jì)區(qū)的自身的特點(diǎn)及其法制現(xiàn)狀的不足之處,從法制建設(shè)的指導(dǎo)原則,提高立法的層級,完善立法內(nèi)容和注重立法質(zhì)量等四個(gè)方面,提出了對經(jīng)濟(jì)區(qū)法制建設(shè)的幾點(diǎn)建議。
[Abstract]:Guangxi Beibu Gulf Economic Zone was officially promoted as a national strategy in January 2008. It is the fifth comprehensive supporting reform experimental area approved by the state and the only comprehensive supporting reform experimental area in China with the function of international regional economic cooperation. Its open development is not only related to the development of Guangxi, but also stimulates the economic takeoff of the western region, and has great significance to the coordinated development of the national economy. Therefore, the economic zone since its establishment has been concerned by all parties, but also received a lot of support. After expounding the background and significance of the topic and defining the article, this paper introduces the forming process of Beibu Gulf Economic Zone and analyzes the advantages and characteristics of Beibu Gulf Economic Zone. At the same time, because of the dual attributes of "economic zone" and "comprehensive reform test area" of economic zone, the article also devoted a certain space to the analysis of this, in order to clarify the relationship between attributes and pave the way for the following. The analysis of the present situation of the legal system is the basis of the research on the construction of the legal system. Therefore, the author starts with the "regulations of Guangxi Beibu Gulf Economic Zone" as a local law, and takes into account the promotion policies of the country and the autonomous region, which are the legislative preparations, and so on. An analysis of the existing law of the economic zone is made. After pointing out the shortcomings of the existing legal system, this paper sums up the beneficial experiences of some foreign countries in the process of regional economic development, as well as other domestic comprehensive reform pilot areas in the process of reform and development. In view of the characteristics of the economic zone and the shortcomings of the present legal system, from four aspects, such as guiding principles of legal construction, raising the level of legislation, perfecting the content of legislation and paying attention to the quality of legislation, Some suggestions on the legal construction of economic zone are put forward.
