【摘要】：傳統(tǒng)的法制觀,強調(diào)經(jīng)濟基礎對法的決定性作用,強調(diào)法的工具價值。這種觀念反映在當前的行政管理中,產(chǎn)生了與社會主義法治要求不相符合的種種問題。從法治思想的起源,以及它在西方兩千年的發(fā)展歷史來看,是一種帶有強烈理念色彩的理論。因此,在法治實踐的過程中,要重視法治的理念屬性。社會主義法治對以往優(yōu)秀的價值觀具有兼容并包性,它能夠吸納西方傳統(tǒng)法治觀念中的先進理念,并從社會主義的原則出發(fā),比以往的法治類型更為優(yōu)越,體現(xiàn)了其特有的價值性。社會主義行政法治的實現(xiàn),一方面必須要注重法治所固有的古典自然主義理論基礎,注重法治的價值理性,遵循法的本質(zhì)規(guī)律,從法治的原則出發(fā),樹立秩序、公平、民主的價值目標,喚起人們對于行政法治的認同感,促進法律的良好運行。另外一方面,社會主義行政法治的價值目標,要從社會現(xiàn)實出發(fā),要符合社會主義原則,符合人性需要,規(guī)范權(quán)力運行,解決行政管理中不適應社會發(fā)展,不符合社會公眾要求之處。正是在這兩點上,社會主義行政法治才具備其應有的價值。目前,社會主義行政法治,在價值目標方面還不夠明晰,缺乏對社會主義行政法治價值目標的深層次辨析,也因此沒有建立屬于社會主義性質(zhì)的法治模式。從社會主義行政法治價值目標實現(xiàn)的障礙來看,由于受傳統(tǒng)價值觀影響,受工具主義法學思想的影響,以及法治信仰的缺失,我國社會主義行政法治價值目標的建立,還有很長的歷程要走。
[Abstract]:The traditional view of legal system emphasizes the decisive role of economic base on law and the instrumental value of law. This concept is reflected in the current administration, which causes various problems which are not in accordance with the socialist rule of law. From the origin of the thought of rule of law and its development history in the west in 2000, it is a theory with strong idea color. Therefore, in the practice of the rule of law, we should attach importance to the concept of the rule of law attribute. The socialist rule of law is inclusive of the outstanding values of the past. It can absorb the advanced ideas from the western traditional concept of rule of law, and proceed from the socialist principle, which is superior to the former type of rule of law. It embodies its unique value. To realize the socialist administrative rule of law, on the one hand, we must pay attention to the theoretical basis of classical naturalism inherent in the rule of law, to the value rationality of the rule of law, to the essential law of law, to the establishment of order and fairness from the principle of rule of law. The value goal of democracy arouses people's sense of recognition for administrative rule of law and promotes the good operation of law. On the other hand, the value goal of the socialist administrative rule of law should be based on social reality, conform to socialist principles, meet the needs of human nature, standardize the operation of power, and resolve the unsuitability of administration to social development. Areas that do not meet the requirements of the public. It is on these two points that the socialist administrative rule of law has its due value. At present, the socialist administrative rule of law is not clear enough in the aspect of value goal, lacks the deep level discrimination to the socialist administrative rule of law value goal, therefore also has not established the socialist nature rule of law pattern. From the point of view of the obstacles to the realization of the value goal of the socialist administrative rule of law, because of the influence of the traditional values, the influence of the instrumentalist legal thought, and the lack of the belief in the rule of law, the establishment of the value goal of the socialist administrative rule of law in our country There is still a long way to go.
