【摘要】：民法典的實際功能遠未如其最初的倡導者所設想的那么完備。但傳統(tǒng)民法典所內含的一種由概念、原理及其價值訴求所構成的法的"認知體系"具有深刻的理性基礎和長遠的指導價值考慮到當代中國的法治化進程和民法制度的現實格局,兼顧國際法制領域的最新趨勢,民法典作為一種形式化工具在當代中國社會進程中的地位已相對下降。當代中國民法典編纂的意義主要在于民法體系建設本身的"守成性"完善,結合"法制的穩(wěn)定性"價值,其方向應當做出如下調整:放棄形式意義上的民法典,而致力于完善實質意義上的民法體系這樣的民法體系就是"邦聯式體系"。"邦聯式體系"大大增強了民法"外在體系"的開放性和實用性并給未來中國民法的發(fā)展保留了更大的可能性,因而不失為一種歷史經驗主義的務實選擇。
[Abstract]:The actual function of the Civil Code is far less complete than its original proponents thought. However, the "cognitive system" of law, which is composed of concepts, principles and value demands, contained in the traditional Civil Code has a profound rational foundation and long-term guiding value, considering the process of rule of law in contemporary China and the realistic pattern of the civil law system. In consideration of the latest trend in the field of international legal system, the status of civil code as a formal tool in the process of contemporary Chinese society has declined. The significance of the codification of contemporary Chinese civil code mainly lies in the perfection of the civil law system construction itself. Combined with the value of "the stability of the legal system", the direction of the codification should be adjusted as follows: to give up the civil code in the formal sense, And the system of civil law, which is devoted to perfecting the system of civil law in essence, is the Confederate system. " Confederate system has greatly enhanced the openness and practicability of the "external system" of the civil law and reserved a greater possibility for the development of Chinese civil law in the future, so it is a practical choice of historical empiricism.
