非政府組織的法律規(guī)制研究

【摘要】:隨著我國社會(huì)主義市場(chǎng)經(jīng)濟(jì)的發(fā)展,以及我國對(duì)外政策的開放,非政府組織在促進(jìn)社會(huì)文明與社會(huì)進(jìn)步方面的作用越來越突出,許多非政府組織代表著國家的形象出現(xiàn)在了世界政治舞臺(tái)并逐漸發(fā)揮著國際性作用。然而,在當(dāng)下的中國,非政府組織對(duì)大部分中國人都是陌生的形象,殊不知,其早已在許多發(fā)達(dá)國家和發(fā)展中國家成為政府公共事務(wù)管理中不可或缺的一部分,由于缺乏對(duì)非政府組織的了解,有的人甚至將其當(dāng)作“反政府組織”,這對(duì)于非政府組織的發(fā)展,對(duì)于我國現(xiàn)代化建設(shè)來說都是非常不利的。 非政府組織在我國的政治文明建設(shè)和公共管理中都是不可或缺的環(huán)節(jié)。在政治文明建設(shè)方面,其充分體現(xiàn)了公民社會(huì)發(fā)展;在公共管理方面,其扮演著“三分為天下有其一”的角色,連同政府和企業(yè)構(gòu)成多元化的治理結(jié)構(gòu)。完善非政府組織與政府的關(guān)系,有利于發(fā)揮非政府組織的功能,從而更好的服務(wù)社會(huì)主義建設(shè)。非政府組織在改革開放以來推動(dòng)了公共管理領(lǐng)域建設(shè),其與政府組織相得益彰的配合,起到了共同完善社會(huì)服務(wù)的作用,因此,對(duì)非政府組織法律規(guī)制研究具有重要的意義,非政府組織已經(jīng)成為我國行政改革與創(chuàng)新的迫切問題,并成為我國法律規(guī)制研究中值得思考和審視的熱點(diǎn)問題和前沿問題之一。本文分為四個(gè)部分: 第一部分,主要闡述了非政府組織的法律規(guī)制的基本原理,探討了非政府組織的概念、特征、積極功能和消極功能。 第二部分闡述了我國非政府組織目前的法律規(guī)制現(xiàn)狀所存在的問題,如立法位階較低,雙重管理滯后、救濟(jì)出現(xiàn)“真空”等。于是在對(duì)非政府組織的法律規(guī)制的現(xiàn)狀進(jìn)行分析的基礎(chǔ)上,本文從立法、行政、司法三個(gè)角度論述了我國目前對(duì)非政府組織進(jìn)行法律規(guī)制的缺陷。同時(shí)也從我國非政府組織所處的環(huán)境著手,分析了對(duì)其進(jìn)行法律規(guī)制的必要性。我國民主法治的建設(shè)、市場(chǎng)經(jīng)濟(jì)體制的健全、全球一體化的推進(jìn)既為我國非政府組織的發(fā)展提供了機(jī)遇,又對(duì)我國非政府組織提出了挑戰(zhàn)。 第三部分闡述了對(duì)中國當(dāng)代非政府組織進(jìn)行法律規(guī)制時(shí)所應(yīng)堅(jiān)持的原則。對(duì)非政府組織進(jìn)行法律規(guī)制,必須要有原則性,不能任意的進(jìn)行規(guī)制,因此本部分提出了法律規(guī)制時(shí)所要堅(jiān)持的四大原則即法治、法律保留、“有限性”干預(yù)、內(nèi)外規(guī)制相結(jié)合。 第四部分介紹了完善我國非政府組織的法律規(guī)制的途徑。結(jié)合我國非政府組織的法律規(guī)制所存在的問題及其所處的社會(huì)環(huán)境,從立法、行政、司法三個(gè)角度論述如何完善我國非政府組織的法律規(guī)制途徑。
[Abstract]:With the development of our socialist market economy and the opening of our country's foreign policy, the role of non-governmental organizations in promoting social civilization and social progress has become more and more prominent. Many NGOs represent the national image in the world political arena and gradually play an international role. However, in today's China, non-governmental organizations are unfamiliar to most Chinese people. However, they have become an integral part of the management of government public affairs in many developed and developing countries. Because of the lack of understanding of non-governmental organizations, some people even regard them as "anti-government organizations", which is very disadvantageous to the development of non-governmental organizations and to the modernization of our country. Non-governmental organizations are indispensable links in the construction of political civilization and public administration in China. In the construction of political civilization, it fully embodies the development of civil society, and in the aspect of public administration, it plays the role of "three parts of the world have one", together with the government and enterprises constitute a pluralistic governance structure. Perfecting the relationship between NGOs and the government is beneficial to bring the functions of NGOs into full play and serve the socialist construction better. Since the reform and opening up, non-governmental organizations have promoted the construction of public management field. The cooperation of non-governmental organizations with government organizations has played a role in improving social services. Therefore, it is of great significance to study the legal regulation of non-governmental organizations. Non-governmental organizations have become an urgent issue of administrative reform and innovation in China, and have become one of the hot and frontier issues in the study of legal regulation in China. This paper is divided into four parts: The first part mainly expounds the basic principles of the legal regulation of NGOs, and probes into the concept, characteristics, positive and negative functions of NGOs. The second part expounds the problems existing in the current legal regulation of the non-governmental organizations in China, such as the low level of legislation, the lag of double management, the emergence of "vacuum" in relief and so on. On the basis of analyzing the current situation of the legal regulation of non-governmental organizations, this paper discusses the defects of the legal regulation of non-governmental organizations in China from the three angles of legislation, administration and judicature. At the same time, it analyzes the necessity of legal regulation from the environment of non-governmental organizations in our country. The construction of democracy and the rule of law, the perfection of market economic system and the promotion of global integration not only provide opportunities for the development of Chinese non-governmental organizations, but also present challenges to our non-governmental organizations. The third part expounds the principles that should be adhered to in the legal regulation of contemporary Chinese NGOs. The legal regulation of non-governmental organizations must be principled and not arbitrary. Therefore, this part puts forward four principles to be adhered to in the legal regulation: rule of law, legal retention, "limited" intervention. The combination of internal and external regulation. The fourth part introduces the ways to perfect the legal regulation of non-governmental organizations in our country. Combined with the problems existing in the legal regulation of non-governmental organizations in China and their social environment, this paper discusses how to perfect the ways of legal regulation of non-governmental organizations in China from the three angles of legislation, administration and judicature.
