【摘要】：對(duì)"人之為人"的理解和定位,會(huì)影響到一國(guó)法律制度的樣式和風(fēng)貌。東西方法律對(duì)人之圖像的不同預(yù)設(shè),造成了日后不同的法律發(fā)展方向。在個(gè)人主義法治模式中,對(duì)人的預(yù)設(shè)是原子式的、自由平等的,并且是理性自利的。社群主義法治模式所體現(xiàn)的是處于社群中的集體人之圖像。德國(guó)式法治建立在康德"自由人"的哲學(xué)理念之上,對(duì)人的尊嚴(yán)予以了重點(diǎn)保護(hù),既尊重了人的個(gè)性,也處理了人與國(guó)家和社會(huì)的關(guān)系�，F(xiàn)代中國(guó)社會(huì)的人之圖像,既承續(xù)了古代中國(guó)的人之圖像,也整合了近現(xiàn)代追求自由和尊嚴(yán)的人之圖像。以這樣一幅人之圖像為構(gòu)成性因素的中國(guó)法治建設(shè),需要借鑒古今中外的法治經(jīng)驗(yàn),以建構(gòu)出一種立足中國(guó)實(shí)際又兼容并蓄的法治模式。
[Abstract]:The understanding and orientation of "man as man" will affect the style and style of a country's legal system. The different presupposition of human image in the law of East and West has resulted in different directions of legal development in the future. In the model of individualism, the presupposition of man is atomic, free and equal, and rational and self-interested. The model of communitarianism embodies the image of the collective people in the community. The German-style rule of law is based on Kant's philosophy of "free man", which focuses on the protection of human dignity. It not only respects human individuality, but also deals with the relationship between human beings and the state and society. The image of man in modern China not only inherits that of ancient China, but also integrates the image of man who pursues freedom and dignity in modern times. The construction of China's rule of law with such a human image as its constituent factor needs to draw lessons from the experience of rule of law at all times and at home and abroad in order to construct a model of rule of law based on China's reality and inclusiveness.
