【摘要】： 我國現(xiàn)行的法律制度,是在根據(jù)地時(shí)期法律制度的基礎(chǔ)上逐步發(fā)展、演變而來的。我們現(xiàn)在對(duì)法律理念的認(rèn)識(shí),對(duì)法律現(xiàn)象的理解,都或多或少的受到根據(jù)地時(shí)期法制意識(shí)的影響。從某種程度上可以說,革命根據(jù)地的法律制度是我國現(xiàn)行法律制度的源頭。新中國成立以后,出于總結(jié)根據(jù)地法治建設(shè)經(jīng)驗(yàn)的需要,政府大力支持專家學(xué)者們對(duì)革命根據(jù)地時(shí)期的法制建設(shè)進(jìn)行研究。在這個(gè)歷史背景之下,眾多的專家學(xué)者投入了極大的熱情與精力。他們?nèi)〉昧司薮蟮某删?期間出現(xiàn)了一批有重要影響的專家和著作。這一研究熱潮一直延續(xù)到20世紀(jì)80年代。隨著改革開放的深入,人們關(guān)注的社會(huì)熱點(diǎn)問題不斷的變化以及專家學(xué)者們學(xué)術(shù)旨趣的轉(zhuǎn)移,有關(guān)革命根據(jù)地法律制度的研究逐漸被冷落。 改革開放30年以來,在市場經(jīng)濟(jì)的建設(shè)當(dāng)中,我國大量的移植了西方國家的法律制度,而忽略了我們傳統(tǒng)法制資源地繼承。在這個(gè)移植的浪潮中,幾乎形成了西方學(xué)術(shù)話語一統(tǒng)天下的學(xué)術(shù)局面。但是,當(dāng)前我國無論是法制建設(shè)抑或是法治建設(shè)都沒有取得預(yù)期的效果,反而丟掉了自己的傳統(tǒng)特色。正如蘇力教授所說:“西方的法律在中國沒有社會(huì)基礎(chǔ),中國法制之路必須注重利用中國本土法制資源,注重中國傳統(tǒng)的文化和實(shí)際�！泵鎸�(duì)中國法制建設(shè)的困境,一些專家學(xué)者開始進(jìn)行反思并且轉(zhuǎn)向中國法制傳統(tǒng)資源的研究。加強(qiáng)研究中國本土法制資源,尤其是加強(qiáng)對(duì)根據(jù)地時(shí)期法律制度的研究,有助于我們對(duì)現(xiàn)行的法治建設(shè)進(jìn)行客觀的反省,有助于我們對(duì)西方現(xiàn)代法制進(jìn)行科學(xué)的評(píng)價(jià)。所以在進(jìn)行畢業(yè)論文選題的時(shí)候,在導(dǎo)師的幫助下我選擇了右江革命根據(jù)地土地法制作為切入點(diǎn)進(jìn)行研究。 在寫作的過程中,為了避免簡單的堆砌材料或者從“客位”的角度進(jìn)行主觀的評(píng)價(jià),筆者多次到右江革命根據(jù)地進(jìn)行實(shí)地調(diào)研,盡量收集第一手材料。本文從右江革命根據(jù)地特殊的地理位置和歷史演變?nèi)胧?通過對(duì)采訪筆錄、民間傳說和歷史敘事詩進(jìn)行考察,在綜合分析各種研究資料的基礎(chǔ)上進(jìn)行論述,試圖以一個(gè)現(xiàn)代法律人的眼光,站在根據(jù)地時(shí)期的歷史高度,還原右江革命根據(jù)地土地法制建設(shè)的歷史真相并進(jìn)行客觀的評(píng)價(jià)。本文淺薄的研究正是在此背景和基礎(chǔ)上展開的。具體而言,本文由引言和正文組成。在引言中,筆者概述了右江革命根據(jù)地的地理位置和社會(huì)情況,并簡單的介紹了右江革命根據(jù)地法制的研究狀況和筆者的研究方法。 正文第一部分旨在探討右江革命根據(jù)地土地法制建設(shè)的基礎(chǔ)。這一部分從右江地區(qū)早期的東蘭農(nóng)民運(yùn)動(dòng)開始進(jìn)行考察,通過分析右江地區(qū)早期農(nóng)民運(yùn)動(dòng)的起源以及發(fā)展,揭露當(dāng)時(shí)右江地區(qū)主要的社會(huì)矛盾,尋找右江地區(qū)發(fā)生土地革命的內(nèi)在原因。接著,對(duì)百色起義進(jìn)行考察,試圖探究共產(chǎn)黨對(duì)右江地區(qū)農(nóng)民運(yùn)動(dòng)的影響以及右江蘇維埃政府建立以后對(duì)右江地區(qū)土地革命的領(lǐng)導(dǎo)作用。從這兩方面的考察結(jié)果來分析右江革命根據(jù)地土地法制建設(shè)的基礎(chǔ)。 正文第二部分主要探討右江革命根據(jù)地的土地政綱。筆者通過考察右江地區(qū)早期農(nóng)民運(yùn)動(dòng)土地政綱從“改造舊社會(huì)政治、經(jīng)濟(jì)、文化”到“取消苛捐雜稅,實(shí)行耕者有其田”的發(fā)展,再到后來《廣西東蘭革命委員會(huì)最低政綱(草案)》的形成,從土地政綱的變化發(fā)展來考究右江地區(qū)早期農(nóng)民運(yùn)動(dòng)的發(fā)展情況以及廣大貧苦農(nóng)民對(duì)土地利益的訴求。接著,筆者對(duì)右江蘇維埃政權(quán)時(shí)期的土地政綱進(jìn)行考察,得出共產(chǎn)黨對(duì)右江地區(qū)土地革命地貢獻(xiàn)是卓越的。 正文第三部分主要論述右江革命根據(jù)地土地法制的主要內(nèi)容。右江革命根據(jù)地土地法制的主要內(nèi)容集中體現(xiàn)在《右江蘇維埃政府土地法暫行條例》和《右江蘇維埃政府共耕條例》兩部法律之中。筆者對(duì)這一部分的論述也分為兩個(gè)方面來進(jìn)行,試圖全面的展示右江革命根據(jù)地土地法制的主要內(nèi)容。在全面論述這兩部法律的基礎(chǔ)上,可見右江革命根據(jù)地土地法制不管在立法技術(shù)或者是立法精神抑或是立法內(nèi)容都達(dá)到了較高的水平,某些部分的規(guī)定其水平甚至超過當(dāng)時(shí)中央革命根據(jù)地的立法水平。 正文第四部分主要探討右江革命根據(jù)地土地法制的實(shí)施。從自發(fā)的農(nóng)民運(yùn)動(dòng)到最后爆發(fā)震驚中國的百色起義,右江革命根據(jù)地的建立具有非常特殊的歷史背景。正是由于發(fā)展經(jīng)歷的特殊性,右江革命根據(jù)地土地法制的實(shí)施過程也不同尋常。它不僅成功的解決了右江革命根據(jù)地廣大貧苦農(nóng)民對(duì)土地的需求,有效地鞏固了右江革命根據(jù)地的蘇維埃政權(quán),而且極大豐富了革命根據(jù)地的土地法制理論。
[Abstract]:The current legal system in our country is gradually developed and evolved on the basis of the legal system in the base areas . We now have great enthusiasm and energy for the understanding of the legal concept and the understanding of the legal phenomena . In this historical background , many experts and scholars have devoted great enthusiasm and energy .



After 30 years of reform and opening - up , in the construction of market economy , our country has greatly transplanted the legal system of western countries , and ignored the inheritance of traditional legal system resources .



In the process of writing , in order to avoid simple building materials or subjective evaluation from the perspective of " passenger position " , the author makes a series of research on the history of the right jiang revolutionary base area and tries to collect the first hand material . In the introduction , the author gives an overview of the geographical position and social situation of the right jiang revolutionary base area , and briefly introduces the research situation of the legal system of the right jiang revolutionary base area and the research method of the author .



The first part of the text is to discuss the foundation of the construction of the land legal system in Youjiang revolutionary base area . This part starts with the movement of the peasant movement in the early stage of Youjiang area . Through analyzing the origin and development of the early peasant movement in Youjiang area , this part reveals the inner reason of the land revolution in Youjiang area . Then , the paper tries to explore the influence of the Communist Party on the peasant movement in the Youjiang area and the leadership role of the right jiang Soviet government in establishing the land revolution in Youjiang area .



The second part of the text mainly discusses the land politics of the Youjiang revolutionary base area . The author tries to study the development of the early peasant movement in the Youjiang area and the demand for the land benefit from the change of the land and politics from the change of the land politics . Then , the author makes a study on the land politics in the Youjiang Soviet regime , and concludes that the Communist Party has made great contribution to the land revolution in the Youjiang area .



The third part of the text mainly discusses the main contents of the land legal system in Youjiang revolutionary base area . The main contents of the land legal system in the Youjiang revolutionary base area are mainly reflected in the two laws of the Provisional Regulations on the Land Law of the Soviet Government of the Youjiang Revolutionary Base and the Soviet Government of the right jiang Soviet Government .



The fourth part of the text mainly discusses the implementation of the land legal system in Youjiang revolutionary base area . It is very special historical background to establish the right jiang revolutionary base area from the spontaneous peasant movement to the last outbreak . It is precisely because of the particularity of the development experience , the implementation of the right jiang revolutionary base area land legal system is very unusual . It not only successfully solved the demand for the land by the poor peasants in the right jiang revolutionary base area , effectively consolidated the soviet regime in the right jiang revolutionary base area , but also greatly enriched the theory of the land legal system in the revolutionary base areas .
