【摘要】: 五千年的悠久歷史鑄就了中華民族的燦爛文化,博大精深的文化底蘊(yùn)中關(guān)于誠(chéng)信的描述更是璨若星海。在經(jīng)濟(jì)全球一體化以及多元文化并存的時(shí)代,誠(chéng)信的內(nèi)涵已經(jīng)遠(yuǎn)遠(yuǎn)超越了傳統(tǒng)文化所賦予的意義,在全面進(jìn)行法治化的今天增添了許多新的內(nèi)容,同時(shí)賦予了誠(chéng)信新的時(shí)代內(nèi)涵。法治是誠(chéng)信文化建設(shè)的土壤,而誠(chéng)信文化是法治進(jìn)程的推動(dòng)力量,本文將誠(chéng)信文化建設(shè)的研究置于法治化的背景下,通過(guò)一系列具體的措施和手段,以及各方面積極有效地配合,形成系統(tǒng)的誠(chéng)信體系,在法治化的進(jìn)程中打下誠(chéng)信的烙印。 本文首先分析了傳統(tǒng)誠(chéng)信的起源和發(fā)展。原始社會(huì)在文字尚未產(chǎn)生以前就萌發(fā)了傳統(tǒng)的誠(chéng)信觀念,但是并沒(méi)有形成系統(tǒng)的理論,只是散見(jiàn)在人們的生產(chǎn)活動(dòng)中。到了文字發(fā)明以后,有關(guān)誠(chéng)信的描述逐漸增多,歷史軌跡發(fā)展到了先秦儒家基本拋棄了迷信的色彩,形成了較為系統(tǒng)的理論,成為文人志士修身自省的準(zhǔn)則,只是這時(shí)的誠(chéng)信還主要是以?xún)?nèi)心的道德義務(wù)為本位,還有許多時(shí)代局限。隨著時(shí)代的變遷,傳統(tǒng)的誠(chéng)信觀已經(jīng)無(wú)法適應(yīng)時(shí)代的潮流,必須進(jìn)行現(xiàn)代轉(zhuǎn)型。這樣我們就要剔除掉傳統(tǒng)誠(chéng)信中缺陷的部分,把精華的部分繼承和發(fā)展下來(lái),形成現(xiàn)代的誠(chéng)信文化理論,更好的為經(jīng)濟(jì)建設(shè)和法治進(jìn)程服務(wù)。 在過(guò)去的歷史中,封建社會(huì)的驅(qū)使迫使中國(guó)走上了人治的道路,人治幾乎成了社會(huì)弊病的源頭。伴隨著新中國(guó)的誕生和一系列大政方針的開(kāi)展,我們最終拋棄了人治選擇了法治的道路。歷史和實(shí)踐證明只有法治才能是與現(xiàn)代化的社會(huì)狀況相適應(yīng)的治理方式。在全面推行法治化進(jìn)程的今天,誠(chéng)信文化的建設(shè)尤為重要。誠(chéng)信文化需要法治作為其外部保障,法治社會(huì)也需要誠(chéng)信文化作為它的內(nèi)在品質(zhì)。然而,社會(huì)上出現(xiàn)的一些誠(chéng)信缺失問(wèn)題只是從表象上進(jìn)行治理是不徹底的,我們需要剖析失信行為產(chǎn)生的深層原因,其中既有經(jīng)濟(jì)上的原因也有文化和制度的因素。本文通過(guò)對(duì)國(guó)外先進(jìn)征信國(guó)家的學(xué)習(xí)和借鑒,并結(jié)合我國(guó)自己的國(guó)情,考慮到失信行為的產(chǎn)生根源,對(duì)我國(guó)的誠(chéng)信文化建設(shè)提出了一些自己的看法和觀點(diǎn)。
[Abstract]:The long history of five thousand years has cast the splendid culture of the Chinese nation.In the era of global economic integration and the coexistence of multiculturalism, the connotation of honesty and credit has gone far beyond the significance given by traditional culture, and has added many new contents to the overall legalization of the country today.At the same time, it gives a new connotation of honesty and credit.The rule of law is the soil of the construction of the culture of honesty, and the culture of honesty is the driving force of the process of ruling by law. This paper puts the study of the construction of the culture of honesty under the background of the rule of law, and through a series of concrete measures and means,And all aspects actively and effectively cooperate, form a system of integrity, in the process of rule by law to lay the brand of good faith.This paper first analyzes the origin and development of traditional honesty.The primitive society had germinated the traditional concept of honesty before the text was produced, but it did not form a systematic theory, but was scattered in people's production activities.After the invention of characters, the description of honesty and credit gradually increased, and the historical track developed to the pre-Qin Confucianism basically abandoned the color of superstition, formed a more systematic theory, become the literati ideals of self-introspection criteria,But at this time the integrity is mainly based on the moral obligations of the heart, there are many limitations of the times.With the change of the times, the traditional concept of honesty has been unable to adapt to the trend of the times.In this way, we should eliminate the defects of traditional honesty and credit, inherit and develop the essence part, form the modern theory of honesty and credit culture, and better serve the economic construction and the process of ruling by law.In the past, the drive of feudal society forced China to take the road of rule by man, which almost became the source of social ills.With the birth of New China and the development of a series of major policies, we finally abandoned the rule of man and chose the road of rule by law.History and practice have proved that only the rule of law can be adapted to the modern social conditions.In the process of rule by law, the construction of honesty culture is particularly important.The culture of honesty and credit needs the rule of law as its external guarantee and the society of rule of law as its internal quality.However, it is not complete to deal with some problems of honesty and credit in the society only from the appearance. We need to analyze the deep causes of the behavior of dishonesty, among which there are economic reasons as well as cultural and institutional factors.Based on the study and reference of advanced credit reporting countries in foreign countries and the situation of our country, this paper puts forward some views and viewpoints on the construction of honesty and credit culture in our country, taking into account the origin of the behavior of dishonesty.
