【摘要】：中國正處于深刻的社會(huì)轉(zhuǎn)型之中,其治理以法治為指向,視法治為治國理政的基本方式。踐行規(guī)則之治、法律主治和良法之治,構(gòu)建國家統(tǒng)治、社會(huì)自治與個(gè)人自主三者協(xié)同的治理格局,以實(shí)現(xiàn)社會(huì)生活的法秩序構(gòu)造。在法治中國建設(shè)的歷程中,國家的權(quán)威支撐、保障著法律權(quán)威,引領(lǐng)并推動(dòng)著法制變革和法治發(fā)展;而國家的強(qiáng)勢介入以及由此生成的國家主義立場卻又在一定程度上排拒了法律對(duì)權(quán)力的約束,弱化了協(xié)同共治的法治社會(huì)的可行性。國家主義與法治之間的博弈,勢必影響著立法、司法的制度設(shè)計(jì)以及法治實(shí)現(xiàn)方法的理解適用。轉(zhuǎn)型中國的法治化治理需要正視并反思這種國家主義立場,反思其對(duì)法治立場和效用的侵蝕。
[Abstract]:China is in the process of profound social transformation. Its governance takes the rule of law as the direction and regards the rule of law as the basic way of governing the country.In order to realize the legal order structure of social life, the governance of practicing rules, the rule of law and the rule of good law are constructed, and the governance pattern of national rule, social autonomy and individual autonomy is constructed.In the course of the construction of China under the rule of law, the authority of the state is supported, which guarantees the authority of the law and leads and promotes the legal reform and the development of the rule of law.However, the strong intervention of the state and the resultant nationalistic stand to some extent reject the restriction of the law on the power and weaken the feasibility of the rule of law society under the co-rule of law.The game between nationalism and rule of law is bound to affect the legislation, the judicial system design and the understanding and application of the realization method of the rule of law.The rule of law in the transitional China needs to face up to and reflect on the nationalistic stand and its erosion of the standpoint and effectiveness of the rule of law.
