【摘要】：推進(jìn)農(nóng)村法治建設(shè),增強(qiáng)村干部這一"領(lǐng)頭雁"的法治思維是關(guān)鍵。亟須將相關(guān)程序法、實(shí)體法涉及的法律精神、法律原則及法律規(guī)則所蘊(yùn)含的法治思維轉(zhuǎn)化運(yùn)用到村務(wù)管人、管財(cái)、管事工作中。通過程序和實(shí)體正義并重管好"多數(shù)人",引入非訴第三方裁決機(jī)制管好"少數(shù)人";在管理使用錢款中做到及時(shí)正義和公開透明;在檔案規(guī)范中增強(qiáng)證據(jù)意識(shí),在糾紛調(diào)處中堅(jiān)守中立意識(shí),讓所辦之事有據(jù)可查,讓糾紛調(diào)處公平公正。
[Abstract]:It is the key to promote the construction of rural rule of law and strengthen the leading thinking of village cadres.It is urgent to transform the legal spirit, legal principles and legal rules contained in the relevant procedural law, substantive law and legal rules into the management of village affairs, the management of property, and the management of affairs.Through both procedural and substantive justice, we should take care of the "majority", introduce non-litigation third-party adjudication mechanisms to manage the "minority"; ensure timely justice and transparency in the management of the use of money; and enhance the awareness of evidence in the archival norms.In the dispute mediation to adhere to the sense of neutrality, to do things documented, so that dispute mediation fair and impartial.
