【摘要】：行政執(zhí)法人性化是現(xiàn)代行政法治化的必然要求,一個(gè)國家行政執(zhí)法人性化的程度高低決定了這個(gè)國家行政法治化進(jìn)程快慢。隨著我國憲政法治化理念的樹立和行政法治化建設(shè)的不斷進(jìn)步,行政執(zhí)法人性化的行政理念在法治國家的行政執(zhí)法中越為突出和重要。 本文從法治國視野下的行政執(zhí)法人性化的內(nèi)涵和立論基礎(chǔ)出發(fā),論述了法治國的行政執(zhí)法人性化的內(nèi)容、價(jià)值并給出法治國家行政執(zhí)法人性化的合理定位,以及在實(shí)現(xiàn)行政執(zhí)法人性化的過程中,必定會(huì)有法治和人性之間的沖突,筆者提出了沖突的解決方法。隨后,筆者分析了現(xiàn)代法治國家下行政執(zhí)法人性化的現(xiàn)狀并對(duì)有利于行政執(zhí)法人性化和不利于行政執(zhí)法人性化的因素進(jìn)行了分析和闡述。本文探析了現(xiàn)代法治國家下要求的行政執(zhí)法人性化的特殊原則,然而,要想真正的實(shí)現(xiàn)行政執(zhí)法人性化還有一定距離和困難,為此,筆者給出了法治國視野下實(shí)現(xiàn)行政執(zhí)法人性化的解決路徑。
[Abstract]:The humanization of administrative law enforcement is the inevitable requirement of modern administrative legalization. The degree of humanization of a country's administrative law enforcement determines the speed of the process of this country's administrative legalization. With the establishment of the concept of constitutionalism and the continuous progress of the construction of administrative legalization in our country, The humanized administrative idea of administrative law enforcement is more and more important in the administrative law enforcement of a country ruled by law. Starting from the connotation and theoretical basis of humanization of administrative law enforcement under the vision of ruling the country by law, this paper discusses the content, value and reasonable orientation of humanization of administrative law enforcement in a country ruled by law. And in the process of realizing the humanization of administrative law enforcement, there is bound to be a conflict between the rule of law and human nature. The author analyzes the present situation of the humanization of administrative law enforcement in a modern country ruled by law, and analyzes and expounds the factors beneficial to the humanization of administrative law enforcement and the humanization of administrative law enforcement. The special principle of humanization of administrative law enforcement, However, in order to realize the humanization of administrative law enforcement, there is still a certain distance and difficulty. Therefore, the author gives the solution to realize the humanization of administrative law enforcement under the vision of governing the country by law.
