【摘要】：黨的十八大以來,法治中國建設進程穩(wěn)步推進,成果顯著。作為推進民主與法治建設的兩大基本元素——獨立審判與輿論監(jiān)督是一對矛盾統(tǒng)一體,既對立又統(tǒng)一。一方面,二者的良性互動對于促進司法公正和實現(xiàn)社會正義具有重要意義;另一方面,二者的消極互動會降低司法權(quán)威,有損司法公信,在一定程度上甚至會對個案正義產(chǎn)生不良影響。因此,正確認識獨立審判與輿論監(jiān)督的關系,并在此基礎上探索平衡二者關系的具體路徑具有重要的理論和現(xiàn)實意義。本文首先對獨立審判與輿論監(jiān)督的相關基本理論問題進行了探討,梳理和總結(jié)了獨立審判與輿論監(jiān)督的淵源和含義等理論問題。其次,對獨立審判與輿論監(jiān)督的辯證關系進行了詳實的分析和概括,認為二者的對立性在于運行規(guī)律的差別和專業(yè)化與非專業(yè)化的差別,二者的同一性在于對立蘊含同一、政治保證的同一和終極價值追求的同一等三個方面。隨后,本文在對相關數(shù)據(jù)進行加工整理后以實證分析法概括了獨立審判與輿論監(jiān)督的互動現(xiàn)狀,認為當前我國獨立審判與輿論監(jiān)督的互動局面總體上是好的,但是負面影響的存在同"努力讓人民群眾在每一個司法案件中都感受到公平正義"價值理念相悖。關于二者互動出現(xiàn)消極狀況的原因,本文認為原因是雙方的,但是,主要原因即內(nèi)因在于獨立審判一方。以實證分析為依據(jù),本文堅持馬克思主義哲學的矛盾分析法,對平衡二者的辯證關系進行了哲學思考,認為平衡獨立審判與輿論監(jiān)督的辯證關系必須堅持"兩點論"和"重點論"相結(jié)合。平衡二者辨證關系的基本原則是以提升人民法院獨立審判能力為主,以增強輿論監(jiān)督自律和他律為輔;具體路徑包括努力增強人民法院獨立審判的責任意識,努力提高人民法院判決說理能力,不斷加強審判隊伍建設;不斷增強輿論自律與輿論監(jiān)督他律建設。同時,人民法院還必須落實好司法公開,做好對輿論的回應與引導。
[Abstract]:Since the 18 National Congress of the Party, the process of building China under the rule of law has progressed steadily, with remarkable results. As two basic elements in promoting democracy and rule of law, independent trial and public opinion supervision are a pair of contradictory unity, both opposite and unified. The positive interaction between them is of great significance to promote judicial justice and realize social justice, on the other hand, the negative interaction between them will reduce the judicial authority and damage the judicial public trust. To a certain extent, it may even have a negative impact on the justice of individual cases. Therefore, to correctly understand the relationship between independent trial and public opinion supervision, On this basis, it is of great theoretical and practical significance to explore the specific path of balancing the relationship between the two. This paper first discusses the basic theoretical issues related to independent trial and public opinion supervision. Combing and summing up the theoretical problems such as the origin and meaning of independent trial and public opinion supervision. Secondly, the dialectical relationship between independent trial and public opinion supervision is analyzed and summarized in detail. The author thinks that the antagonism of the two lies in the difference of the operation law and the difference between specialization and non-specialization, and the identity of the two lies in three aspects: the contradiction implies the same, the political guarantee is the same and the ultimate value is the same. This paper summarizes the current situation of the interaction between independent trial and public opinion supervision by empirical analysis after processing the relevant data, and thinks that the interactive situation between independent trial and public opinion supervision in China is generally good. However, the existence of negative effects is contrary to the value of "trying to make the people feel fair and just in every judicial case." as to the reasons for the negative state of interaction between the two, this paper argues that the reasons are of both sides, but, On the basis of empirical analysis, this paper insists on the contradiction analysis of Marxist philosophy, and makes philosophical thoughts on balancing the dialectical relationship between the two. The author holds that the dialectical relationship between independent trial and public opinion supervision must be combined with "two points theory" and "emphasis theory". The basic principle of balancing the dialectical relationship between them is to enhance the people's court's ability of independent trial. The specific ways include strengthening the sense of responsibility of independent trial of the people's court, improving the judgment reasoning ability of the people's court, and strengthening the construction of the judicial team. At the same time, the people's court must carry out the judicial publicity well and make a good response and guidance to the public opinion.
