【摘要】：平衡法研究既有深厚的法治實踐背景,也有部門法研究為支撐。隨著全面法治建設(shè)的不斷推進,平衡法研究將有利于中國社會主義法治理論的不斷豐富,有利于社會主義法治實踐的不斷拓展,有利于社會主義法治實踐的經(jīng)驗總結(jié),也有利于文化建設(shè)。當(dāng)前,平衡法研究不但要具備全球化、規(guī)范化和方法論的理論視野,還要處理好"法律一元"與"法律多元"、社科法學(xué)與教義法學(xué)、法律本土主義與法律現(xiàn)代化等方面提出的理論命題,回應(yīng)社會主義法治實踐中的重大現(xiàn)實問題。
[Abstract]:The study of balance law has not only deep background of law practice, but also the support of department law. With the continuous development of the construction of comprehensive rule of law, the study of balance law will be beneficial to the enrichment of the theory of socialist rule of law in China. It is beneficial to the continuous expansion of the practice of socialist rule of law, to the summary of experience in the practice of socialist rule of law, and to the construction of culture. At present, the study of balance method should not only have a theoretical perspective of globalization, standardization and methodology, It is also necessary to deal with the theoretical propositions put forward in such aspects as "legal monism" and "legal pluralism", social science jurisprudence and doctrine, legal nativism and legal modernization, in order to respond to the important practical problems in the practice of socialist rule of law.
