【摘要】：欲行法治,必先立法,有法可依乃法治之基。地方行政立法是我國立法體系的重要組成部分,其立法形式具有靈活性、補(bǔ)充性、實(shí)施性等特點(diǎn),是地方政府進(jìn)行經(jīng)濟(jì)和社會事務(wù)管理的有效方式和手段。在中國法制尚不完備的情況下,地方行政立法的經(jīng)驗(yàn)創(chuàng)新為中國特色社會主義法律體系的建設(shè)做出了重要的貢獻(xiàn),為國家立法提供了寶貴的經(jīng)驗(yàn)和基礎(chǔ)。隨著社會主義民主和法制的健全,加強(qiáng)對地方行政立法的研究,是現(xiàn)代立法科學(xué)化、民主化和法制化的必然要求,對于加強(qiáng)和改進(jìn)地方行政立法工作,全面推進(jìn)依法行政,建設(shè)法治政府,創(chuàng)造地方優(yōu)良法制環(huán)境,保障行政管理相對人的合法權(quán)益具有十分重要的意義。 遼寧作為東北老工業(yè)基地,體制轉(zhuǎn)變的大省,地方行政立法工作起步較早,取得了一定的成果,也存在著一些問題,亟待從理論上并結(jié)合實(shí)踐進(jìn)行研究并加以解決。基于此,針對遼寧省地方行政立法的理論和實(shí)踐上的研究較少的現(xiàn)狀,本文通過理論與實(shí)踐研究,綜合運(yùn)用文獻(xiàn)分析、比較分析、統(tǒng)計(jì)分析等分析方法,針對遼寧省地方行政立法,即遼寧省政府規(guī)章的立法情況進(jìn)行分析,從歷史沿革到發(fā)展現(xiàn)狀以及存在問題,尋找適合遼寧省省情的運(yùn)作機(jī)制,提出完善和改進(jìn)遼寧省地方行政立法的對策建議,最終得以促進(jìn)遼寧省經(jīng)濟(jì)社會快速平穩(wěn)發(fā)展,為完善社會主義法律體系添磚加瓦。 本文以遼寧省地方行政立法的發(fā)展為研究背景,從管理學(xué)、法學(xué)的視角對遼寧省地方行政立法的現(xiàn)狀進(jìn)行了客觀分析,特別運(yùn)用PEST和SWOT分析模型,對遼寧省地方行政立法的宏觀環(huán)境(包括政治法律環(huán)境、經(jīng)濟(jì)環(huán)境、社會環(huán)境、技術(shù)環(huán)境)進(jìn)行了系統(tǒng)分析。同時(shí),對遼寧省地方行政立法進(jìn)行SWOT態(tài)勢分析,分析存在的優(yōu)勢與劣勢,面臨的機(jī)遇和挑戰(zhàn),從而將遼寧省地方行政立法同遼寧省所處的外部環(huán)境,內(nèi)部資源有機(jī)地結(jié)合起來,科學(xué)地診斷遼寧省地方行政立法工作存在的一系列問題,在一定程度上影響到地方立法質(zhì)量的提高,影響到遼寧省發(fā)展改革的軟環(huán)境建設(shè)。針對存在的問題,提出了四項(xiàng)對策建議：一是科學(xué)編制立法規(guī)劃,從源頭上保障立法工作的整體質(zhì)量；二是切實(shí)推進(jìn)民主立法,實(shí)施民主立法、完善聽證和調(diào)查研究制度；三是完善地方立法保障機(jī)制,提高人員素質(zhì),突出地方特色,開展立法后評估,定期清理,質(zhì)量保障平臺建設(shè)；四是堅(jiān)持并完善區(qū)域立法協(xié)作制度,促進(jìn)省際立法交流。
[Abstract]:If we want to enforce the rule of law, we must first legislate. The local administrative legislation is an important part of our country's legislative system, and its legislative form is characterized by flexibility, complementarity and implementation. It is an effective way and means for local governments to manage economic and social affairs. Under the condition of incomplete legal system in China, the experience innovation of local administrative legislation has made important contributions to the construction of socialist legal system with Chinese characteristics. With the development of socialist democracy and the sound of the legal system, it is necessary to strengthen the research on the local administrative legislation for the scientific, democratic and legalization of modern legislation. It is of great significance to strengthen and improve the work of local administrative legislation, to comprehensively promote administration by law, to build a government ruled by law, to create a good local legal environment, and to protect the legitimate rights and interests of relative persons in administrative management. Liaoning, as an old industrial base in Northeast China, is a big province with a changing system. The work of local administration and legislation started earlier, achieved some achievements, and has some problems, which need to be studied and solved in theory and in combination with practice. In view of the fact that the research on the theory and practice of the local administrative legislation in Liaoning Province is less, this paper aims at the local administrative legislation of Liaoning Province through theoretical and practical research, comprehensive use of literature analysis, comparative analysis, statistical analysis and other analytical methods. That is, the legislative situation of Liaoning Provincial Government regulations is analyzed, from historical evolution to development status and existing problems, to find out the operating mechanism suitable for Liaoning Province, and to put forward countermeasures and suggestions to perfect and improve the local administrative legislation in Liaoning Province. Finally, it can promote the rapid and steady development of Liaoning's economy and society, and contribute to the perfection of the socialist legal system. Based on the background of the development of local administrative legislation in Liaoning Province, this paper makes an objective analysis of the present situation of local administrative legislation in Liaoning Province from the perspectives of management and law, especially using PEST and SWOT analysis models. This paper makes a systematic analysis of the macro environment (including political and legal environment, economic environment, social environment, technical environment) of local administrative legislation in Liaoning Province. At the same time, it analyzes the SWOT situation of local administrative legislation in Liaoning Province. This paper analyzes the advantages and disadvantages, the opportunities and challenges faced by Liaoning Province, and organically combines the local administrative legislation of Liaoning Province with the external environment and internal resources of Liaoning Province. To scientifically diagnose a series of problems existing in the work of local administrative legislation in Liaoning Province, to a certain extent, affect the improvement of the quality of local legislation and the construction of soft environment for the development and reform of Liaoning Province. Four countermeasures and suggestions are put forward: first, scientific legislative planning to ensure the overall quality of legislative work from the source; second, promoting democratic legislation, implementing democratic legislation, perfecting the system of hearing and investigation and research; The third is to perfect the local legislative guarantee mechanism, to improve the quality of personnel, to highlight local characteristics, to carry out post-legislative evaluation, to regularly clean up, and to build a quality assurance platform; fourth, to adhere to and improve the system of regional legislative cooperation, and to promote inter-provincial legislative exchanges.
