【摘要】： 罪犯尤其是被剝奪政治權(quán)利的罪犯是否享有知識產(chǎn)權(quán)呢?這一追問背后隱含著諸多的法律問題,如罪犯知識產(chǎn)權(quán)與政治權(quán)利的關(guān)系問題,罪犯知識產(chǎn)權(quán)與刑罰執(zhí)行的問題,罪犯知識產(chǎn)權(quán)的保障方式問題等等。隨著社會的發(fā)展和法治的進步,罪犯人權(quán)基本上得到了保障,作為民事權(quán)利的知識產(chǎn)權(quán)也隨之引起了人們的關(guān)注。法治社會強調(diào)對公民權(quán)利的維護。罪犯的知識產(chǎn)權(quán)未被依法剝奪,理應(yīng)受到法律的有效保障。多年來,無論在法學(xué)理論界還是司法實踐中均很少論及罪犯的知識產(chǎn)權(quán)保障問題。而從監(jiān)獄工作實踐來看,我國知識產(chǎn)權(quán)法、監(jiān)獄法等法律制度對罪犯知識產(chǎn)權(quán)的保障還是很欠缺的。在我國法治進程中,進一步完善中國特色的罪犯知識產(chǎn)權(quán)保障制度就顯得十分必要了。本文從三個方面論證了罪犯知識產(chǎn)權(quán)保障的相關(guān)問題。 第一部分,主要闡述了罪犯知識產(chǎn)權(quán)保障的基本理論。首先介紹了知識產(chǎn)權(quán)與罪犯知識產(chǎn)權(quán)的含義,分析了罪犯知識產(chǎn)權(quán)的主體、客體、內(nèi)容。然后試分析了罪犯知識產(chǎn)權(quán)保障的含義,通過概念內(nèi)涵可得出罪犯知識產(chǎn)權(quán)保障有別于普通公民,具有保障主體的多樣性、客體受限性與獨特性,權(quán)利保障方式的側(cè)重性及糾紛解決方式的局限性等特點。然后分析了罪犯知識產(chǎn)權(quán)保障的理論基礎(chǔ)與現(xiàn)實必要性問題�？茖W(xué)的罪犯知識產(chǎn)權(quán)保障制度應(yīng)有科學(xué)的理論體系作支撐,法治理論、人權(quán)理論和科學(xué)發(fā)展觀理論就成為罪犯知識產(chǎn)權(quán)保障的重要理論基礎(chǔ)。其次,從構(gòu)建和諧社會、監(jiān)獄的科學(xué)發(fā)展及罪犯的再社會化等方面簡要分析了我國罪犯知識產(chǎn)權(quán)保障的現(xiàn)實必要性。 第二部分,主要分析了我國罪犯知識產(chǎn)權(quán)保障存在的問題和原因。首先,從我國立法方面對罪犯知識產(chǎn)權(quán)保障的不足開始,分析了我國現(xiàn)行憲法、知識產(chǎn)權(quán)法、監(jiān)獄法等法律法規(guī)對罪犯知識產(chǎn)權(quán)保障方面的規(guī)定及存在的問題,并進行了法理層面的分析。其次,分析了我國監(jiān)獄執(zhí)法方面對罪犯知識產(chǎn)權(quán)保障的相對滯后。再次,分析了我國罪犯知識產(chǎn)權(quán)司法保障的缺乏。最后,本文對我國罪犯知識產(chǎn)權(quán)保障存在問題的原因進行了概述。中國傳統(tǒng)觀念的影響、社會承受能力的反應(yīng)、監(jiān)獄工作理念的制約和罪犯權(quán)利觀念的偏差等等都是罪犯知識產(chǎn)權(quán)保障出現(xiàn)問題的重要原因。憲法、刑法等法律之間的沖突引起了罪犯知識產(chǎn)權(quán)保障在法律適用上的困境,由于我國憲法中規(guī)定了公民的政治權(quán)利,刑法中規(guī)定了對犯罪人政治權(quán)利的剝奪,其中對言論和出版自由的剝奪直接影響著罪犯知識產(chǎn)權(quán)的行使和保障問題。這是一個頗有爭議的又亟待解決的問題。 第三部分,著重提出了完善我國罪犯知識產(chǎn)權(quán)保障制度的一些理性思考。首先,分析了我國罪犯知識產(chǎn)權(quán)立法保障的設(shè)計理念問題。對我國的罪犯知識產(chǎn)權(quán)立法保障模式的設(shè)計理念進行了理論和實踐上的探討。罪犯知識產(chǎn)權(quán)法律保障模式應(yīng)選擇以監(jiān)獄法制保障為重點,以知識產(chǎn)權(quán)法律保障為依據(jù),以行政法規(guī)、部門規(guī)章保障為補充的參考模式。我國的法律體系和有關(guān)國際公約成為了構(gòu)建罪犯知識產(chǎn)權(quán)保障體系的重要內(nèi)容和法律淵源。其次,規(guī)范我國監(jiān)獄機關(guān)的執(zhí)法運行機制是罪犯知識產(chǎn)權(quán)最重要的保障方式。要著力從增加監(jiān)獄保障經(jīng)費、完善監(jiān)獄管理制度、加強監(jiān)獄文化建設(shè)、培養(yǎng)罪犯正確的知識產(chǎn)權(quán)意識、完善罪犯的自力救濟制度、建立罪犯權(quán)利保障組織、完善監(jiān)獄的執(zhí)法監(jiān)督機制等方面進行建設(shè),從而根本保障罪犯的知識產(chǎn)權(quán)。知識產(chǎn)權(quán)行政機關(guān)的執(zhí)法保障和共建社會保障制度,也是保障罪犯知識產(chǎn)權(quán)的必不可少的重要方面。再次,完善我國罪犯知識產(chǎn)權(quán)的司法保障制度也非常重要。建立司法機關(guān)對監(jiān)獄法制的司法審查制度、完善罪犯的司法救濟程序、建立監(jiān)獄機關(guān)與司法機關(guān)的協(xié)調(diào)聯(lián)動機制等,都是司法制度保障方面需要改進和完善之處。
[Abstract]:Especially the criminals have been deprived of political rights or intellectual property rights of criminals? Behind this question implies many legal problems, such as the relationship between the criminal of intellectual property rights and political rights, intellectual property rights and criminal penalty, criminal intellectual property protection mode and so on. With the development of society and the progress of the rule of law the human rights of criminals, basically guaranteed, as the civil rights of intellectual property has also attracted the attention of the people. The society under the rule of law emphasizes the protection of the rights of citizens. The intellectual property rights of criminals are not deprived of by law, should be effectively protected by the law. Over the years, both in legal theory and judicial practice are rarely mentioned criminals the intellectual property protection problem. From the prison practice, China's intellectual property law, security law and other legal system of Prison Criminals of intellectual property is still under In the process of rule of law, it is very necessary to further improve the system of intellectual property rights protection with Chinese characteristics. This paper demonstrates the related problems of intellectual property rights protection of criminals from three aspects.
The first part mainly expounds the basic theory of criminal protection of intellectual property. The intellectual property and the criminals first introduced the meaning of intellectual property, analysis of the criminal subject, the object of intellectual property, and then try to analyze the content. The meaning of intellectual property protection of criminals, criminals can be obtained through the concept of connotation of intellectual property protection is different from the ordinary citizens the diversity of the main, security, limitation and unique characteristics of the object, so as to solve the limitation of focusing and protection of the rights disputes. And then analyzes the theoretical basis of the criminal protection of intellectual property and realistic necessity. The criminal of intellectual property protection system should be scientific scientific theoretical system for support, the theory of rule of law the theory of human rights, and Scientific Outlook on Development has become an important theoretical basis of the criminal theory of intellectual property protection. Secondly, from the construction of harmonious society, scientific development and the crime of the prison It is a brief analysis of the practical necessity of the intellectual property protection of criminals in our country.
The second part mainly analyzes the existing problems and reasons of the criminal protection of intellectual property in our country. First of all, to lack of intellectual property protection from the criminal legislation in our country, analyzes the current constitution of our country, intellectual property law, the provisions of criminal protection of intellectual property and the existing problems of the prison law and other laws and regulations, and the analysis of the legal level. Secondly, analyzes China's prison law enforcement to protect intellectual property rights of criminals is relatively backward. Thirdly, analysis of China's criminal judicial protection of intellectual property rights lack. Finally, this paper on intellectual property protection in China criminal problems are discussed. China influence of traditional ideas, social tolerance response, restrict prison work concept and the concept of the rights of criminals are criminals and deviation of intellectual property protection an important reason for the problem. The third part puts forward some rational thoughts on perfecting the criminal protection of intellectual property system. Firstly, the paper analyzes the design ideas of protection of intellectual property rights legislation of our country criminal problem. The design idea of China's criminal legislation on intellectual property rights protection mode are discussed on theory and practice of the criminal law of intellectual property protection mode. We should choose the prison legal protection as the focus, in order to protect the intellectual property rights law, administrative regulations, departmental rules and security as a complementary reference model. The legal system of our country and the relevant international conventions has become an important content and construction of the criminal legal system of intellectual property protection of origin. Secondly, standardize law enforcement operation mechanism of China's prison authority is the way to protect intellectual property rights of criminals most important. We must focus on the increase of prison security funds, improve the prison management system, strengthening the cultural construction of prison culture The criminal right consciousness of intellectual property rights, improve the criminal self relief system, the establishment of the criminals' rights protection organization, perfecting prison law enforcement supervision mechanism construction, so as to guarantee the criminal law enforcement to protect intellectual property rights. Intellectual property agency and build administrative organs of the security system, but also to protect the indispensable criminals of intellectual property. Again, is also very important to improve the system of judicial protection of intellectual property rights of criminals in China. The establishment of the judicial organ judicial review system of prison legal system, perfecting the criminal judicial remedy procedure, establish linkage mechanism to coordinate the prison authorities and judicial organs, are the judicial protection system needs to be improved.
