【摘要】：哈貝馬斯認(rèn)為,只有當(dāng)事實(shí)的有效性及法律規(guī)范的有效性同時得到保障時,法律的有效性才能得到保障。目前,由于載體語言的情景性和模糊性、相關(guān)成文法的滯后性與一般性、大學(xué)代議制的必然性和有限性致使大學(xué)法治管理體系不完善、行政權(quán)力對學(xué)術(shù)權(quán)利的"殖民化"管理、人治傾向所導(dǎo)致的"家長制"決策方式風(fēng)行等張力凸顯,影響了大學(xué)法治建設(shè)的有效性。建立健全"理性辯論機(jī)制",促進(jìn)多元法律主體溝通,可以有效緩解大學(xué)法治建設(shè)有效性的張力問題。
[Abstract]:Habermas believes that the validity of the law can only be guaranteed when the validity of the facts and the validity of the legal norms are guaranteed at the same time.At present, due to the situational and vague nature of the carrier language, The lag and generality of relevant statutory law, the inevitability and limitation of university representative system, the imperfection of university rule of law management system, and the "colonization" management of academic rights by administrative power. The tension of "patriarchal system" decision-making style, which is caused by the tendency to rule by man, is prominent, which affects the validity of the construction of the rule of law in universities, establishes and perfects the "rational debate mechanism", and promotes the communication of multiple legal subjects. It can effectively alleviate the tension problem of the validity of the construction of university rule of law.
