論我國網(wǎng)絡(luò)民主監(jiān)督機(jī)制的完善

【摘要】:隨著經(jīng)濟(jì)的發(fā)展,人們的生活水平越來越高。當(dāng)人們?cè)诮?jīng)濟(jì)上得到滿足后,人們開始尋求政治上的權(quán)利。網(wǎng)絡(luò)的興起在一定程度上反映了民眾的權(quán)利意識(shí)的增強(qiáng),人們要求有更多知情權(quán)和參政、議政的權(quán)利,來保護(hù)自己的利益不被公權(quán)力機(jī)關(guān)侵犯。網(wǎng)絡(luò)民主監(jiān)督順應(yīng)民眾的需求得到了發(fā)展,更重要的是,網(wǎng)絡(luò)民主監(jiān)督這種監(jiān)督途徑有其自身的優(yōu)勢(shì),比如其自身具有虛擬性、廣泛參與性、理想性、強(qiáng)制性的特點(diǎn)。也由于網(wǎng)絡(luò)民主監(jiān)督從根本上來說是公民的表達(dá)自由權(quán)的一種,是憲法賦予公民的一種權(quán)利,這促使網(wǎng)絡(luò)民主監(jiān)督能對(duì)我國公權(quán)力機(jī)關(guān)的行為進(jìn)行約束,使其更好的為我國人民服務(wù)。但是任何權(quán)利都不是不受限制的絕對(duì)權(quán)利,由于網(wǎng)絡(luò)民主監(jiān)督的門檻低,參與范圍廣,這造成了網(wǎng)民容易濫用自身的權(quán)利,對(duì)自身監(jiān)督權(quán)限缺乏明確的把握;從而,使網(wǎng)絡(luò)民主監(jiān)督容易演變?yōu)榍址腹珓?wù)人員的隱私權(quán),也難于區(qū)分政務(wù)公開與保守秘密的界限。另外,面對(duì)網(wǎng)上真假信息,網(wǎng)上的以訛傳訛,網(wǎng)民的道德素質(zhì)就受到了考驗(yàn)。由于網(wǎng)絡(luò)民主監(jiān)督是個(gè)新生事物,我國沒有一套專門的法典進(jìn)行規(guī)范,也沒有程序上的專門立法,其在監(jiān)督中就容易對(duì)國家機(jī)關(guān)造成負(fù)面影響。因此,本人建議從實(shí)體上和程序上進(jìn)行立法來規(guī)范網(wǎng)民的行為,并且本人提出了針對(duì)網(wǎng)民對(duì)公務(wù)員的侵權(quán)承擔(dān)侵權(quán)責(zé)任并進(jìn)行賠償,在網(wǎng)絡(luò)監(jiān)督中確立網(wǎng)絡(luò)提供商的法律責(zé)任。并從制度上提出建立專門的網(wǎng)上監(jiān)督機(jī)構(gòu)和監(jiān)督標(biāo)準(zhǔn),并從提高公務(wù)員素質(zhì)方面,提出規(guī)范網(wǎng)絡(luò)民主監(jiān)督。在如何進(jìn)一步發(fā)揮網(wǎng)絡(luò)民主監(jiān)督作用的優(yōu)勢(shì)方面,本人從增設(shè)網(wǎng)民代表、為網(wǎng)絡(luò)民主監(jiān)督創(chuàng)造更加便利的制度途徑,進(jìn)一步發(fā)揮新聞媒體的輿論監(jiān)督作用提出了一些自己的看法。本文的創(chuàng)新之處:一是從程序上對(duì)網(wǎng)絡(luò)民主監(jiān)督進(jìn)行立法并提出了網(wǎng)民可向?qū)iT的政府官方網(wǎng)站申請(qǐng)資格,注冊(cè)申請(qǐng)時(shí)使用實(shí)名和有效的身份證件申請(qǐng)?jiān)捳Z權(quán)等一系列程序,并把這一系列程序用立法的形式確定下來。二是對(duì)網(wǎng)民侵犯公務(wù)員人格權(quán)、身份權(quán)進(jìn)行精神損害賠償,三是確立網(wǎng)上監(jiān)督標(biāo)準(zhǔn)中提出證據(jù)制度。文章的不足是:一是在選舉中增設(shè)網(wǎng)民代表,本人認(rèn)為在理論上在選舉中增設(shè)網(wǎng)民代表有助于我國網(wǎng)絡(luò)民主監(jiān)督作用的發(fā)揮,但是在現(xiàn)實(shí)中這一制度的實(shí)際操作和運(yùn)用上還需要進(jìn)一步思考。二是在公務(wù)員的隱私權(quán)和公民的知情權(quán)之間把握上還要進(jìn)行思考。
[Abstract]:With the development of economy, people's living standard is getting higher and higher. When people get satisfied in economy, people begin to seek political rights. People demand more right to know, to participate in politics, to discuss politics, to protect their interests from encroachment by public power organs. Democratic supervision on the Internet has developed to meet the needs of the public, and more importantly, This way of supervision of network democracy has its own advantages, such as its own characteristics of virtual, extensive participation, ideal, and compulsion. Also, because the network democratic supervision is fundamentally a kind of citizen's right to freedom of expression, It is a kind of right granted by the Constitution to citizens, which urges the democratic supervision on the Internet to restrain the behavior of the public power organs in our country and make it better serve the people of our country. But any right is not unlimited absolute right. Because the threshold of network democratic supervision is low and the scope of participation is wide, this causes Internet users to abuse their own rights and lack a clear grasp of their own supervision authority. It is also difficult to distinguish between open and secret government affairs. In addition, in the face of the true and false information on the Internet, the moral quality of Internet users is tested. Since democratic supervision on the Internet is a new thing, Our country does not have a set of special codes to regulate, nor does it have special legislation of procedure, which can easily have a negative impact on state organs in the course of supervision. Therefore, I suggest that legislation should be made from both substantive and procedural aspects to regulate the behavior of Internet users. And I propose to assume tort liability and compensate for the infringement of civil servants by Internet users, establish the legal liability of network provider in network supervision, and put forward the establishment of special online supervision organization and supervision standard from the system. And from the aspect of improving the quality of civil servants, it is proposed to standardize the network democratic supervision. In terms of how to further exert the advantages of the network democratic supervision, I create a more convenient system way for the network democratic supervision by adding the Internet users' representatives. The innovation of this paper is to legislate the network democratic supervision from the procedure and put forward that the Internet users can apply for the qualification to the special government official website. When applying for registration, a series of procedures, such as real names and valid identity documents, are used to apply for the right to speak, and this series of procedures is determined in the form of legislation. Second, compensation for moral damage to Internet users infringing upon the personality rights of civil servants and the right to identity. The third is to establish the evidence system in the online supervision standard. The shortcomings of the article are: first, to increase the number of Internet users' representatives in the election. I think that the addition of Internet surrogate representatives in the election in theory is conducive to the exertion of the role of democratic supervision on the Internet in our country. However, in reality, the actual operation and application of this system still needs further thinking. Second, it is necessary to think about the relationship between the civil servant's right to privacy and the citizen's right to know.
