【摘要】： 法治是一個(gè)越來越重要的概念。不管學(xué)者們?nèi)绾味x法治,法治的普遍含義以及法治的實(shí)現(xiàn),才是最重要的。實(shí)現(xiàn)法治的方式有許多模式,但都可以歸結(jié)為兩個(gè)方面的因素：法治實(shí)現(xiàn)的硬件,即完善的客觀法律制度；以及社會(huì)主體的人的法治素質(zhì)的提高。因此本文從法治主體暨公民的法治意識(shí)這個(gè)角度來思考法治建設(shè)應(yīng)該考慮的相關(guān)因素。法治意識(shí),是基于法律意識(shí)的一個(gè)概念,它又是形成法治精神的基礎(chǔ)。它承前啟后,具有樞紐作用。我們希望社會(huì)生活普遍按照法治精神來運(yùn)行。而法治意識(shí)正是法治精神得以形成的必須。 本文主要基于法治理論來引入法治意識(shí)的概念,因?yàn)榉ㄖ我庾R(shí)必須以法治的內(nèi)容為基礎(chǔ)；在分析當(dāng)前中國法治意識(shí)缺失原因的基礎(chǔ)上,提出了培育當(dāng)代法治意識(shí)的途徑。本文分三個(gè)部分：第一部分,基于法治的內(nèi)涵和法治的精神來論述法治意識(shí)及其重要性,法治是一種理想的社會(huì)生活方式,法治精神是追求這種生活方式所必須有的,而法治意識(shí)是基于法律意識(shí)上的使法治精神得以培育和存在的關(guān)鍵。第二部分,分析了我國現(xiàn)階段法治意識(shí)缺失的現(xiàn)狀及原因,由于歷史文化傳統(tǒng)和現(xiàn)有的機(jī)制體制等因素的影響,我國公民法治意識(shí)普遍淡薄。第三部分,要解決當(dāng)前我國社會(huì)中存在的法治意識(shí)普遍淡薄的現(xiàn)狀,必須溯本索源,從制度上去解決問題,從公民素質(zhì)上去解決問題,這就必然涉及到我們現(xiàn)有的教育制度的改革。 總之,法治意識(shí)對(duì)推進(jìn)法治建設(shè)非常重要,法治意識(shí)是從法治的主體公民本身來解決法治問題。公民的法治意識(shí)提高了,有關(guān)法治建設(shè)的相關(guān)因素就自然會(huì)得到解決。
[Abstract]:The rule of law is an increasingly important concept. No matter how scholars define the rule of law, the universal meaning of the rule of law and the realization of the rule of law are the most important. There are many ways to achieve the rule of law. However, it can be attributed to two factors: the hardware of the realization of the rule of law, that is, the perfect objective legal system; And the improvement of the legal quality of the social subjects. Therefore, this paper considers the relevant factors in the construction of the rule of law from the perspective of the subject of the rule of law and citizens' awareness of the rule of law. The consciousness of the rule of law is based on the concept of legal consciousness. It is also the basis of forming the spirit of rule of law. It is a link between the past and the future and plays a pivotal role. We hope that social life generally runs in accordance with the spirit of the rule of law, and the consciousness of the rule of law is the necessity for the formation of the spirit of the rule of law. This paper mainly introduces the concept of consciousness of rule of law based on the theory of rule of law, because the consciousness of rule of law must be based on the content of rule of law, and on the basis of analyzing the reasons for the lack of consciousness of rule of law in China at present, This paper puts forward the ways to cultivate the contemporary consciousness of the rule of law. This paper is divided into three parts: the first part, based on the connotation of the rule of law and the spirit of the rule of law, discusses the consciousness of the rule of law and its importance, which is an ideal way of social life. The spirit of the rule of law is necessary to pursue this kind of life style, and the consciousness of the rule of law is the key to the cultivation and existence of the spirit of the rule of law based on the consciousness of law. The second part analyzes the present situation and reasons of the lack of the consciousness of the rule of law at the present stage in our country. Due to the influence of the historical and cultural tradition and the existing mechanism and system, the awareness of the rule of law of Chinese citizens is generally weak. The third part, in order to solve the current situation of the generally weak consciousness of the rule of law existing in our society, we must trace back to the source of the law. To solve the problems from the system and from the quality of the citizens will inevitably involve the reform of our existing education system. In a word, the consciousness of the rule of law is very important to promote the construction of the rule of law, and the consciousness of the rule of law is to solve the problem of the rule of law from the subject citizen of the rule of law.
