【摘要】：隨著我國(guó)社會(huì)主義法治建設(shè)進(jìn)程的不斷推進(jìn),近年來(lái),如聶樹(shù)斌案、復(fù)旦投毒案等一系列典型法制案例報(bào)道越來(lái)越多地受到黨和政府的重視,在受眾中也得到了廣泛地關(guān)注。典型法制案例報(bào)道意義重大,可以以活生生的法制案例給受眾以形象生動(dòng)的教育,喚醒人們的法律意識(shí),起到潛移默化的作用。正是基于此,媒體特別是黨報(bào),充分意識(shí)到典型法制案例報(bào)道的重要性,但同時(shí)在報(bào)道中也出現(xiàn)了些許問(wèn)題。然而,根據(jù)筆者對(duì)“典型法制案例報(bào)道”這一關(guān)鍵詞所做的學(xué)術(shù)史梳理來(lái)看,學(xué)界對(duì)此的研究幾乎是一個(gè)空白。中國(guó)知網(wǎng)數(shù)據(jù)庫(kù)中,對(duì)于法制案例報(bào)道的論文也只有7篇,主要是對(duì)法制案例報(bào)道的新聞選擇、價(jià)值、及物性系統(tǒng)研究、功能等方面進(jìn)行研究。《光明日?qǐng)?bào)》作為新中國(guó)成立之初由民主同盟創(chuàng)辦的以知識(shí)分子為主要對(duì)象的報(bào)紙,承擔(dān)著貫徹黨中央的方針政策、宣傳無(wú)產(chǎn)階級(jí)文化思想的任務(wù)。因此,《光明日?qǐng)?bào)》自創(chuàng)生以來(lái)就獨(dú)樹(shù)一幟,與其他中共黨報(bào)相比具有鮮明的特征,其典型法制案例報(bào)道也有其鮮明的特征。本研究選擇以《光明日?qǐng)?bào)》典型法制案例報(bào)道(1998—2016)為文本,從文本分析的角度,對(duì)《光明日?qǐng)?bào)》典型法制案例報(bào)道進(jìn)行探究,通過(guò)這一研究,以求填補(bǔ)典型法制案例報(bào)道及《光明日?qǐng)?bào)》典型法制案例報(bào)道的空白。本研究主要分為四個(gè)部分:第一部分主要概述研究對(duì)象、研究意義、研究現(xiàn)狀、研究方法及研究范圍的界定等。第二部分通過(guò)量化分析、文本分析,對(duì)《光明日?qǐng)?bào)》典型法制案例報(bào)道進(jìn)行具體的研究。學(xué)術(shù)上,通常將“法制報(bào)道”分為刑事法制、民事法制、經(jīng)濟(jì)法制、文教法制、行政法制5類報(bào)道,據(jù)此,本研究也將典型法制案例報(bào)道分為這5類進(jìn)行探析,即從典型刑事法制案例報(bào)道、典型民事法制案例報(bào)道、典型經(jīng)濟(jì)法制案例報(bào)道、典型文教法制案例報(bào)道、典型行政法制案例報(bào)道五個(gè)角度來(lái)研究;分別從體裁分析、版面分布、報(bào)道主題等三個(gè)方面對(duì)五種典型法制案例報(bào)道進(jìn)行文本分析;在對(duì)每一類典型法制案例報(bào)道研究中,都分別選取了具體典型法制案例來(lái)分析,依次選取聶樹(shù)斌案、張海超開(kāi)胸驗(yàn)肺事件、三鹿奶粉事件、復(fù)旦投毒案、蒼南城管打人事件五個(gè)具體案例,以更加深入地對(duì)《光明日?qǐng)?bào)》典型法制案例報(bào)道進(jìn)行探析。第三部分主要總結(jié)了第二部分對(duì)于《光明日?qǐng)?bào)》文本分析的內(nèi)容,然后從整體上來(lái)分析其中三個(gè)角度的變化趨勢(shì);其次從整體上分析了《光明日?qǐng)?bào)》典型法制案例報(bào)道(1998—2016)的主題話語(yǔ)變遷與措辭風(fēng)格變化。第四部分主要是通過(guò)對(duì)《光明日?qǐng)?bào)》典型法制案例報(bào)道研究,為黨報(bào)如何做好法制新聞報(bào)道提出對(duì)策與建議,主要從遵從“受眾本位論”,體現(xiàn)自身特色;提高新聞工作者法律素養(yǎng),增加受眾法律知識(shí);利用好“媒介偏向理論”,與新媒體互動(dòng)等三個(gè)方面來(lái)闡述。在全球化的大背景下,當(dāng)下的中國(guó)正處于一個(gè)轉(zhuǎn)型時(shí)期,即正處于實(shí)現(xiàn)“中國(guó)夢(mèng)”的關(guān)鍵時(shí)期,與時(shí)俱進(jìn)地審視當(dāng)前黨報(bào)典型法制案例報(bào)道的“精華”或“糟粕”,有助于新聞界認(rèn)識(shí)到典型法制案例報(bào)道的傳播效應(yīng)的優(yōu)缺點(diǎn),以及受眾的情感共鳴和理性認(rèn)知,以便于促使媒體更好地履行普法教育、輿論監(jiān)督等職責(zé)。

However, according to the author of "the typical legal case report" keywords sort of academic history, research in this field is almost a blank. Chinese HowNet database, the legal case reports papers have only 7 articles, mainly on the legal case The news, reported the value of the transitivity system, function and other aspects of research. The third part mainly sums up the second part of the" Guangming Daily "text analysis of the content, then the overall trend analysis of three aspects; then analyzes the" Guangming Daily > typical case reports from the whole legal system (1998 - 2016) the theme of discourse changes and wording changes in style. The fourth part is mainly through the study of typical case report on "legal countermeasures and Guangming Daily." the suggestions for how to do the legal news reports, mainly from the following "audience centered theory", reflecting their own characteristics; improve journalistic legal literacy, legal knowledge to increase the audience; make good use of" The theory of "media bias, and three aspects of interactive new media to elaborate.
