【摘要】：俄羅斯法治在類型化上,受東正教神學(xué)中"權(quán)力觀念"的影響,形成一種"權(quán)力法治"模式,這一模式從根本上說是一種"有神"的法治。當(dāng)前中俄兩國在法治發(fā)展道路選擇上有高度的一致性,本土化與自主性特征明顯,都經(jīng)歷了從文化自覺到自信的過程。當(dāng)代俄羅斯的文化自覺與自信以東正教傳統(tǒng)精神為紐帶,在國家治理中充分發(fā)揮傳統(tǒng)精神文化的凝結(jié)作用。當(dāng)代中國文化自信理論的提出與闡發(fā),給中國法治發(fā)展的精神文化面向指明了方向,它使中國法治在"倫理法治"的目標(biāo)基礎(chǔ)上成為"有魂"的法治。這個"魂"應(yīng)當(dāng)以中國文化為源頭,在中國共產(chǎn)黨領(lǐng)導(dǎo)下,立足中國傳統(tǒng)文化精神,堅(jiān)持中國化的馬克思主義,塑造中國法治的精神之魂。
[Abstract]:The Russian rule of law is influenced by the concept of power in Orthodox theology and forms a mode of "power rule by law". This model is fundamentally a "divine" rule of law. At present, China and Russia have a high degree of consistency in the choice of the road of development of the rule of law, and the characteristics of localization and autonomy are obvious. The cultural consciousness and self-confidence of contemporary Russia are linked by the traditional spirit of the Eastern Orthodox Church. The theory of contemporary Chinese cultural self-confidence has been put forward and elucidated, which has pointed out the direction of the spiritual culture of the development of China's rule of law. It makes the rule of law in China become the rule of law with soul on the basis of the goal of "ethical rule of law", which should be based on the spirit of Chinese traditional culture under the leadership of the Communist Party of China. Adhere to the Chinese Marxism, shape the spirit of the Chinese rule of law.
