【摘要】： 西方協(xié)商民主理論誕生于20世紀(jì)80年代,是針對(duì)代議制民主政治體制在當(dāng)代發(fā)展過(guò)程中表現(xiàn)出的局限性,對(duì)民主本質(zhì)進(jìn)行深刻反思后提出的一套應(yīng)對(duì)之策。近年來(lái),隨著我國(guó)社會(huì)結(jié)構(gòu)日益多元化,積極推進(jìn)協(xié)商民主制度建設(shè)也得到中央高度重視。2006年2月,中共中央下發(fā)《中共中央關(guān)于加強(qiáng)人民政協(xié)工作的意見(jiàn)》,第一次明確提出“人民通過(guò)選舉、投票行使權(quán)利和人民內(nèi)部各方面在重大決策之前進(jìn)行充分協(xié)商,盡可能就共同性問(wèn)題取得一致意見(jiàn),是我國(guó)社會(huì)主義民主的兩種重要形式”。人民政協(xié)是中國(guó)式協(xié)商民主的典型形式和主要載體,人民政協(xié)所堅(jiān)持的協(xié)商民主形式及適應(yīng)世界民主發(fā)展的潮流趨勢(shì),又堅(jiān)持了具有中國(guó)自己特色的民主政治發(fā)展道路,具有廣闊的發(fā)展前景。 本文試圖通過(guò)對(duì)中西協(xié)商民主的對(duì)比研究,闡述中西協(xié)商民主在理論與實(shí)踐方面的異同,力求為我國(guó)的協(xié)商民主發(fā)展提供一些有益的借鑒和啟示。文章首先對(duì)西方協(xié)商民主理論進(jìn)行了梳理,分析了西方協(xié)商民主的主要特征、產(chǎn)生的理論背景,并對(duì)其實(shí)踐形態(tài)進(jìn)行了歸納。然后對(duì)我國(guó)協(xié)商民主的發(fā)展歷程進(jìn)行了回顧,提出政治協(xié)商是協(xié)商民主的重要實(shí)現(xiàn)形式、協(xié)商民主與人民政協(xié)同生共進(jìn)的觀點(diǎn)。在此基礎(chǔ)上,對(duì)中西協(xié)商民主理論從理論淵源、價(jià)值追求、協(xié)商方式、協(xié)商手段等方面進(jìn)行了比較分析,進(jìn)一步論證二者存在著內(nèi)在的聯(lián)系。文章最后從借鑒協(xié)商民主理論完善我國(guó)政治協(xié)商制度出發(fā),從完善協(xié)商程序設(shè)計(jì)、推進(jìn)政協(xié)法制化建設(shè)兩大方面歸納總結(jié)存在的問(wèn)題,提出建議措施。
[Abstract]:The western theory of deliberative democracy was born in 1980s, which is aimed at the limitation of representative democratic political system in the process of contemporary development. In recent years, with the increasing diversity of the social structure of our country, it has been highly valued by the central authorities to actively promote the construction of the consultative democracy system. February 2006. The CPC Central Committee issued the "opinions of the CPC Central Committee on strengthening the work of the people's political Consultative Conference" and for the first time clearly stated that "the people exercise their rights through elections, vote and conduct full consultation among all aspects of the people before major decisions are made." To reach consensus on the issue of commonality as far as possible is two important forms of socialist democracy in our country. "the CPPCC is a typical form and main carrier of Chinese-style deliberative democracy. The Chinese people's political Consultative Conference adheres to the democratic form of consultation and adapts to the trend of the development of democracy in the world, and adheres to the road of democratic political development with China's own characteristics, which has broad prospects for development. This paper attempts to expound the similarities and differences between Chinese and Western consultative democracy in theory and practice through the comparative study of Chinese and Western consultative democracy. This paper tries to provide some useful reference and enlightenment for the development of our country's deliberative democracy. Firstly, the article combs the western theory of deliberative democracy, and analyzes the main characteristics and theoretical background of western consultative democracy. Then it reviews the development course of our country's deliberative democracy, and points out that political consultation is an important form of realizing consultative democracy. On the basis of this, the author makes a comparative analysis of the theory of consultative democracy between China and the West from the theoretical origin, the pursuit of value, the way of negotiation and the means of negotiation. At the end of the article, from the perspective of the theory of deliberative democracy to perfect the political consultation system of our country, to perfect the negotiation procedure design. In order to promote the legal construction of the CPPCC, the author summarizes the existing problems and puts forward some suggestions.
