【摘要】：20世紀(jì)70年代以來,隨著公共事務(wù)的日益多樣化和復(fù)雜化,傳統(tǒng)的“全能政府”模式難以滿足社會發(fā)展需求,政府失靈促使人們開始反思政府壟斷公共事業(yè)管理的不足。由此,“更多依靠民間機構(gòu),更少依賴政府來滿足公眾需求”的公用事業(yè)民營化運動開始興起。這場運動一般認(rèn)為源起于英國,范圍已經(jīng)擴大至全球。 在我國,公用事業(yè)民營化制度已經(jīng)基本確立,但與英美等國相比,我國的公用事業(yè)民營化正處于初期階段,在各個環(huán)節(jié)都缺乏相應(yīng)的規(guī)制。我們需要借鑒國外相關(guān)制度的先進性,同時緊密結(jié)合我國的具體國情,推動公用事業(yè)民營化制度的不斷完善。 本文針對公用事業(yè)民營化這一核心問題進行了系統(tǒng)的研究,共分為六個部分,第一部分,對第一部分,對“公用事業(yè)”、“民營化”的基本認(rèn)識;第二部分,公用事業(yè)民營化在域外的運用;第三部分;公用事業(yè)民營化在中國的應(yīng)用與發(fā)展,分析了他在中國的現(xiàn)實情況、模式和取得的成績;第四部分,我國公用事業(yè)民營化存在的問題及原因分析,得出其發(fā)展需要政府實行必要的規(guī)制;第五部分,我國公用事業(yè)民營化過程中政府規(guī)制的探索,分析了相關(guān)的理論、取得的成績、存在的問題和原因;第六部分,完善我國公用事業(yè)民營化的行政規(guī)制,包括法律調(diào)節(jié)、成立獨立行業(yè)公用事業(yè)監(jiān)管委員會、建立合理化制度,保證程序公正等。
[Abstract]:Since 1970s, with the public affairs of the increasingly diversified and complicated, the traditional "omnipotent government" mode is difficult to meet the needs of social development, government failure prompted people to reflect lack of government monopoly of public utilities management. Thus, more rely on private institutions, privatization is less dependent on government to meet the needs of the public utilities "movement began to rise. This movement generally originated in Britain, the scope has expanded to the world.
In our country, the privatization of public utilities system has been basically established, but compared with other countries, the privatization of public utilities in China is in the early stage, in all aspects of the lack of corresponding regulations. We need to learn from foreign advanced system, and combined with China's specific national conditions, to promote public utilities of the continuous improvement of the system.
Studied the core problem of the privatization of public utilities, is divided into six parts, the first part, the first part of the "utilities", "basic understanding of privatization; the second part, the privatization of public utilities in the extraterritorial application; the third part of the application and development of privatization; public utilities in Chinese, analyzes his reality in Chinese, mode and achievements; the fourth part, analysis of existing problems and causes of the privatization of public utilities in our country, the development needs of the government to implement the necessary regulation; the fifth part, explore the government regulation of the privatization of public utilities in our country in the process of analysis. The relevant theory, achievements, problems and reasons; the sixth part, improve the administrative regulation of the privatization of public utilities in our country, including the legal regulation, the establishment of an independent industry utility regulatory commission, set up To rationalize the system and to ensure the fairness of the procedure.
