【摘要】：自人類社會產(chǎn)生以來,就沒有停止過對正義問題的探索,將其作為解決各種現(xiàn)實問題的重要依據(jù)和道德判斷標準。隨著人類社會的發(fā)展進步,正義的標準和內(nèi)涵也在不斷地發(fā)生變化,每個特定的歷史時期對于不同的人、不同的階級都對應著不同的正義觀。從古希臘到現(xiàn)代社會,從柏拉圖、亞里士多德、洛克、康德再到羅爾斯,都留下了豐富多彩的正義理論和新意迭出的真知灼見。馬克思也在探究正義問題的悠長歷史中,以歷史的視角、科學的理論以及對現(xiàn)實的關(guān)切,形成基于現(xiàn)實的人以及人與社會辯證統(tǒng)一的正義思想。因此,為了回應當代中國對正義的訴求和呼喚,學界開始圍繞“馬克思與正義”問題進行研究。但是,學界大多關(guān)注的是其歷史唯物主義形成之后的正義思想,對于早期馬克思的正義思想鮮有問津。本文試圖通過挖掘馬克思早期文本中的正義思想,探尋“正義”是如何進入馬克思視野的,以及是如何進一步發(fā)展的,使馬克思思想發(fā)展中的隱形線索——對人的自由本性復歸的追求明朗化,為此開展馬克思早期關(guān)于人的自由的正義思想的探求。本文主要從馬克思早期正義思想的時代背景和理論淵源、馬克思早期正義思想的主要內(nèi)容和特點以及馬克思早期正義思想評析三個方面對馬克思早期正義思想進行探尋和論述。首先,考察馬克思早期正義思想產(chǎn)生的時代背景和理論淵源,在家庭熏陶和資本主義飛速發(fā)展的時代背景下,馬克思批判汲取了古希臘哲學、近代自由主義、德國古典哲學、英法古典政治經(jīng)濟學、空想社會主義及其正義思想,形成了獨具特色的正義思想。其次,對馬克思早期正義思想的主要內(nèi)容和特點進行概括總結(jié),主要內(nèi)容可以簡單概括為四個方面:第一,《博士論文》中的理性正義思想,從“自我意識”哲學出發(fā)探尋人的價值;第二,《萊茵報》時期政治權(quán)利的正義思想,從政治的角度揭露社會的種種不平等,描繪了包含自由與平等的正義圖景;第三,《黑格爾法哲學批判》中蘊含的正義思想,通過分析市民社會和國家以及法的關(guān)系,對自己的正義觀念進行審視;第四,《1844年經(jīng)濟學哲學手稿》中人本主義的正義思想,從物質(zhì)關(guān)系視角出發(fā),運用異化勞動理論批判資本主義社會忽視人的現(xiàn)實性。通過對內(nèi)容的總結(jié)概括,可以分析出馬克思早期正義思想具有革命性、人本性和批判性的特點。最后,對馬克思早期正義思想進行評析,第一,闡釋馬克思早期正義思想的歷史地位。第二,論述馬克思早期正義思想的時代局限。第三,闡釋馬克思早期正義思想的當代意義。
[Abstract]:Since the emergence of human society, we have never stopped exploring the problem of justice and regard it as an important basis for solving various practical problems and as a standard of moral judgment. With the development and progress of human society, the standards and connotations of justice are constantly changing. For different people and different classes, there are different views on justice in each specific historical period. From ancient Greece to modern society, from Plato, Aristotle, Locke, Kant to Rawls, all left rich and colorful theory of justice and new ideas. Marx is also exploring the long history of the problem of justice, from the perspective of history, scientific theory and concern for reality, form a dialectical unity of justice thought based on reality of man and society. Therefore, in order to respond to the demand and call for justice in contemporary China, scholars began to study the issue of Marx and Justice. However, scholars mostly pay attention to the justice thought after the formation of historical materialism, and have little interest in the justice thought of early Marx. This paper attempts to explore how "justice" entered Marx's vision and how to develop it further by digging into the thought of justice in Marx's early texts. In order to make the invisible clue in the development of Marx's thought the pursuit of the return of man's free nature clear, the exploration of Marx's early just thought on human freedom was carried out. This paper explores and discusses Marx's early justice thoughts from three aspects: the historical background and theoretical origin of Marx's early justice thought, the main contents and characteristics of Marx's early justice thought and the evaluation and evaluation of Marx's early justice thought. First of all, it examines the background and theoretical origin of Marx's early just thought. Under the background of family edification and the rapid development of capitalism, Marx critically draws on ancient Greek philosophy, modern liberalism, German classical philosophy. Anglo-French classical political economy, utopian socialism and its just thought have formed the unique thought of justice. Secondly, the main contents and characteristics of Marx's early just thought are summarized. The main contents can be summarized in four aspects: first, the rational justice thought in the doctoral thesis, From the philosophy of "self-consciousness" to explore the value of human beings; Second, the political rights of the political rights in the "Rhine newspaper" period of justice thought, from the political point of view to expose all kinds of social inequality, described the picture of justice, including freedom and equality; Third, the justice thought contained in the criticism of Hegel's philosophy of law, through the analysis of the relationship between civil society, state and law, the author examines his own concept of justice. Fourthly, the just thought of humanism in the manuscripts of Economics and philosophy in 1844, from the angle of material relation, criticizes the reality of human being in capitalist society with the theory of alienated labor. By summing up the contents, we can analyze the revolutionary, human and critical features of Marx's early just thought. At last, it analyzes Marx's early justice thought. First, it explains the historical position of Marx's early justice thought. Secondly, it discusses the age limitation of Marx's early thought of justice. Third, explain the contemporary significance of Marx's early thought of justice.
