【摘要】：自中國共產黨第十六屆中央委員會第四次全體會議上正式提出了“構建社會主義和諧社會”的理論后，構建和諧社會成了全社會成員共同努力的戰(zhàn)略目標，全國上下大力建設和諧社會，在這個重大的歷史時期下，實現(xiàn)制度正義對構建和諧社會有著十分重要的影響。公平正義是社會和諧的基本要求之一，是一個社會持續(xù)發(fā)展最應有的環(huán)境氛圍，正義與制度是靈魂與載體的關系，制度將抽象的正義具體呈現(xiàn)在人們的生活中，規(guī)范人們的行為，激勵人們勤奮并努力工作，調動人們積極性，化解人們之間的矛盾，讓人們切身感受到社會的公平公正性，從而凝聚全社會的力量構建社會主義和諧社會。無論是在回顧過去五年的工作和十年的基本總結，還是在部署黨和國家各項事業(yè)時，都特別強調“制度建設”，在剛剛落幕的十八大會議上，“制度”二字更是貫穿整個報告的始終�？梢娭贫仍谖覈鐣l(fā)展中一直發(fā)揮著重大的作用，在構建和諧社會的過程中強調制度正義是必然所在。 本文共有五部分，主要根據(jù)馬克思正義思想、自由思想、制度倫理思想和法哲學思想，并結合我國社會主義建設的實踐經(jīng)驗，在我國社會轉型現(xiàn)狀的基礎上和構建和諧社會的時代背景下，重點闡釋了如何實現(xiàn)制度正義，并論述了制度正義對構建和諧社會的重要作用。文章首先闡述了制度正義的一些思想淵源，然后對制度正義的含義與基本特征及和諧社會的含義與總體要求進行了辨析，談及了制度正義對構建和諧社會的意義，指出了在構建和諧社會的過程中存在的影響制度正義實現(xiàn)的主要因素，最后針對存在的影響提出了如何實現(xiàn)制度正義的一些探索性想法。 第一部分是緒論，介紹了課題的來源及本文的研究結果和國內外對制度正義的研究現(xiàn)狀。 第二部分是對制度正義的思想淵源、含義、基本特征、主要功能及和諧社會概念和總體要求的分析。馬克思在自由思想、制度倫理思想和法哲學基礎上對制度正義展開了研究，對我國制度正義發(fā)展有重要指導意義。歷史上很早就有對正義的討論，正義一直是人們渴望并追求的價值目標，但對制度正義的研究則相對有限。制度與正義是載體與靈魂的關系，但絕不是兩者簡單的結合，正義是對制度道德性的評價標準和被公眾接受程度的反映。社會主義和諧社會是一個社會發(fā)展的戰(zhàn)略目標，是一種和諧、友好并且各階層人民萬眾一心的社會狀態(tài)，而公平正義是和諧社會的重要特征之一。 第三部分主要寫了制度正義對和諧社會的意義所在。秩序是和諧的充分條件，是人類生存和發(fā)展的基本條件，制度正義可以做到持續(xù)維護社會的和諧秩序；自由是和諧社會的終極目標，制度正義是和諧社會構建的基本條件，保障個人自由，幫助和諧社會自由目標的實現(xiàn)；協(xié)調各種利益關系是實現(xiàn)和諧社會的要件之一，通過制度來協(xié)調是最正確的手段，能夠起到高效并妥善協(xié)調利益矛盾的明顯效果；制度正義保障經(jīng)濟正義的實現(xiàn)，創(chuàng)造良好的社會經(jīng)濟框架，促進經(jīng)濟良性發(fā)展；公平正義實現(xiàn)的基礎是合理并完善的正義制度，只有借助制度的制約與保證，才能談及公平正義實現(xiàn)的可能性。 第四部分指出了社會中存在的影響制度正義實現(xiàn)的主要因素。我國歷史上是人治國家，人情倫理取代了公平公正，，要實現(xiàn)制度至上，我們需要改掉這一習慣；過去的社會需要個人利益為公共利益服務和犧牲，隨著和諧社會構建速度的不斷加快，現(xiàn)代社會強調個人利益，強化人們權利意識；由于我國還未完全實現(xiàn)和諧社會，地區(qū)經(jīng)濟的發(fā)展速度和地區(qū)人們具備的文化水平還存在不同步，差異大的現(xiàn)象，造成我國不同地區(qū)的人們對正義觀念的理解和界定有分歧；司法活動的公平公正對制度正義的實現(xiàn)也有著重要意義，其包括制定和執(zhí)行法律的過程，司法是社會安全的最后一道防線，司法活動的順利開展為構建和諧社會打造了良好的社會環(huán)境，若司法活動出現(xiàn)癱瘓將是整個社會的災難。 第五部分講述的是制度正義的實現(xiàn)。隨著建設和諧社會的進程不斷加大，將自由作為和諧社會的最終目標是時代所需，我們要為實現(xiàn)共產主義社會努力奮斗。所以，有必要強調自由對制度正義的影響，自由原則是制度正義存在和發(fā)展的理論依據(jù)。實現(xiàn)制度正義要有評價的標準來指導我們如何創(chuàng)新制度，告訴我們何種制度算是正義的或者說是貼近正義的；制度正義分為實質正義和形式正義，缺一不可；制度意識的培養(yǎng)是為制度正義實現(xiàn)創(chuàng)造了良好的社會氛圍，一切制度活動都靠人來完成，無論是制定者、執(zhí)行者還是遵守者，都需要從意識上對制度有高度的認可和尊重；在制度正義的實現(xiàn)過程中，對制度制定者和實施者的監(jiān)督必不可少，正義體現(xiàn)在制度制定和運行兩個環(huán)節(jié)中。
[Abstract]:Since the Fourth Plenary Session of the Sixteenth Central Committee of the Communist Party of China formally proposed the theory of "building a socialist harmonious society", the construction of a harmonious society has become a strategic goal for the members of the whole society to work together, building a harmonious society all over the country. In this great historical period, the realization of institutional justice is constructed. A harmonious society has a very important influence. Justice is one of the basic requirements of social harmony. It is the most due environment for the sustainable development of society. Justice and system are the relationship between the soul and the carrier. The system presents the abstract justice in the people's life, rules the behavior of the people, and motivates people to work hard and work hard. To mobilize the enthusiasm of people, resolve the contradictions among people, let people feel the fair and fair society, and thus condense the power of the whole society to build a socialist harmonious society. Whether it is in the past five years of work and the basic summary of the ten years, or in the deployment of the party and the state, the "system construction" is particularly stressed. At the eighteen conferences that have just ended, the "system" two words run through the whole report all the time. It is visible that the system has played an important role in the social development of our country, and it is necessary to emphasize the justice of the system in the process of building a harmonious society.
This article has five parts, mainly according to Marx's just thought, free thought, institutional ethics and legal philosophy, and combined with the practical experience of socialist construction in our country, on the basis of the present situation of social transformation in China and the construction of a harmonious society, how to realize the system justice, and discuss the system justice. The important role of the construction of a harmonious society. The article first elaborated some ideological origins of institutional justice, then analyzed the meaning and basic characteristics of the system justice and the meaning of the harmonious society and the general requirements, and talked about the significance of institutional justice to the construction of a harmonious society, and pointed out the shadow of the existence of the process of building a harmonious society. Finally, in view of the impact, some tentative ideas about how to achieve institutional justice are put forward.
The first part is the introduction, which introduces the source of the subject and the research results of this paper and the current research situation of institutional justice at home and abroad.
The second part is the analysis of the ideological origin, the meaning, the basic features, the basic features, the main functions and the concept of harmonious society and the general requirements. Marx has studied the system justice on the basis of free thought, institutional ethics and legal philosophy, and has important guiding significance to the development of institutional justice in China. Justice is the value goal that people desire and pursue, but the research on institutional justice is relatively limited. System and justice are the relationship between the carrier and the soul, but it is not a simple combination of the two. Justice is the evaluation standard of the system morality and the reflection of the public acceptance. The socialist harmonious society is a society. The strategic goal of development is a harmonious, friendly and social state of unity among all strata of the people, and fairness and justice is one of the important characteristics of a harmonious society.
The third part mainly writes about the meaning of the system justice to the harmonious society. The order is the full condition of harmony, the basic condition of human existence and development, the system justice can maintain the harmonious order of the society continuously; the freedom is the ultimate goal of the harmonious society, the system justice is the basic condition for the construction of the harmonious society, and guarantees the individual self. It will help the realization of the free goal of the harmonious society, and the coordination of all kinds of interests is one of the important elements to realize the harmonious society. It is the most correct means to coordinate the harmonious society. It can play the obvious effect of efficient and proper coordination of the contradiction of interests; the system justice ensures the reality of economic justice, creates a good social and economic framework and promotes the economy. The foundation of the realization of fair and justice is the reasonable and perfect justice system. Only by the aid of the system's restriction and guarantee can we talk about the possibility of the realization of fair and justice.
The fourth part points out the main factors that affect the realization of institutional justice in the society. In our history, China is the state of rule of man, the ethics of human beings has replaced the fairness and justice, and the system is supreme. We need to change this habit; the past society needs personal interests to serve and sacrifice for the public interest, and the speed of building a harmonious society is not. Because our country has not fully realized the harmonious society, the development speed of the regional economy and the cultural level of the people in the region have not been synchronized and the difference is big, which causes the people in different regions of our country to understand and define the concept of justice. It is also of great significance to the realization of the justice of the system. It includes the process of making and executing the law. Judicature is the last line of defense for social security. The smooth development of judicial activities has created a good social environment for the construction of a harmonious society. If the paralysis of the judicial activities is paralyzed, it will be the disaster of the whole society.
The fifth part is about the realization of the system justice. As the process of building a harmonious society is increasing, the ultimate goal of the freedom as a harmonious society is the needs of the times. We must strive for the realization of the Communist society. Therefore, it is necessary to emphasize the impact of freedom on the justice of the system, and the principle of freedom is the existence and development of institutional justice. Theoretical basis. The realization of institutional justice should have the standard of evaluation to guide us on how to innovate the system, and tell us what kind of system is just or close to justice; system justice is divided into substantive justice and formal justice, and the cultivation of system consciousness is to create a good social atmosphere for the realization of institutional justice. Institutional activities are done by people. Whether they are the makers, the executors or the observant, they all need to have a high degree of recognition and respect to the system from the consciousness. In the process of the realization of the system justice, the supervision of the system makers and the implementers is essential, and justice is embodied in the two links of system setting and operation.
