經(jīng)濟(jì)全球化已經(jīng)成為當(dāng)今社會(huì)的發(fā)展趨勢(shì)。隨著各國對(duì)外交往的日益頻繁,法律翻譯已成為促進(jìn)國家進(jìn)步和實(shí)現(xiàn)社會(huì)繁榮的重要因素。由于社會(huì)進(jìn)步和時(shí)代發(fā)展,對(duì)法律翻譯的需求越來越大,要求越來越高。然而,和國際社會(huì)每日大量的法律文本的翻譯實(shí)踐相比,法律翻譯理論還比較欠缺。同時(shí),法律英語作為一種特殊文體,比文學(xué)語言具有更顯著的邏輯思維特征。從思維的角度看,對(duì)法律英語翻譯主要采用邏輯思維。邏輯作為研究思維的規(guī)律、形式和方法的科學(xué),指導(dǎo)并規(guī)約著翻譯的全過程。在邏輯的指導(dǎo)下進(jìn)行翻譯將會(huì)促進(jìn)法律翻譯理論及其翻譯實(shí)踐的發(fā)展,而正確的利用邏輯也會(huì)大大提高法律翻譯的質(zhì)量。本文從法律英語語言特點(diǎn)分析出發(fā),就邏輯學(xué)相關(guān)理論在法律英語漢譯過程中的運(yùn)用進(jìn)行了探討。 本文首先是對(duì)法律英語翻譯的綜述。介紹法律英語的定義及其在詞、句、篇章層面的特點(diǎn);了解法律翻譯在西方和中國的研究情況;討論翻譯界對(duì)法律翻譯研究力度不夠的問題。接著探討邏輯思維對(duì)法律翻譯的重要作用。文章簡(jiǎn)要闡述邏輯思維的定義及其特點(diǎn)并討論邏輯思維在翻譯過程中的主導(dǎo)作用,同時(shí)分析了一些常見的邏輯錯(cuò)誤,探討由于法律英語中的模糊性和法律翻譯中存在的文化差異所造成的翻譯困難,...
