規(guī)范邏輯是關于“應當”,“允許”等規(guī)范模態(tài)詞的邏輯,又稱為道義邏輯,它是廣義模態(tài)邏輯的一個分支。規(guī)范邏輯在我國的研究起步很晚,最近才有學者對它進行研究。我們在這一領域與國外的差距很大。究其原因,既有規(guī)范邏輯自身的原因,如規(guī)范邏輯悖論的困擾,規(guī)范邏輯沒有能夠建立一個令人信服的系統(tǒng)等;也與人們對規(guī)范邏輯的重要性理解不夠有很大的關系。其實,規(guī)范邏輯的研究不論從邏輯學的角度,還是從法律科學的角度來說都有著十分重要的意義。規(guī)范邏輯的研究特色是把法律作為對象語言進行研究,而把形式語言作為研究對象語言的語言,即元語言,來研究法律基本概念、法律規(guī)范以及它們之間的關系,以使法律體系變成一個內(nèi)在一致的系統(tǒng),消除法律體系內(nèi)的矛盾。這種研究方法實際上是一種“元法學”研究方法,它為法學的研究提供了一種全新的手段和分析工具。本文正是試圖挖掘出規(guī)范邏輯對于法律科學研究的重要意義,它共分五個部分:第一部分主要是對規(guī)范邏輯的發(fā)展史做一些簡要的陳述,它是下面部分的歷史知識的準備。第二部分主要是對馮·賴特的一元規(guī)范命題邏輯做一個概述,并從法律科學的角度對其中若干定理做一些評論。第三部分主要是對標準的二元規(guī)范命題邏輯做一個概述,再從法律科學的角度對其中若干定理做一些評論。第四部分首先對安德森的規(guī)范命題邏輯做一個概述,然后對其中若干定理做一些法律評論。第五部分主要從法律角度對二元規(guī)范命題邏輯做一些簡要的評論。
Normative logic (also called deontic logic), which is about the logic ofobligation, permission and such norm modality, is a branch of broad modal logic. Theresearch on normative logic in China is not for a long time. Only recently somescholars begin to study it. Comparing with western countries, our study in this fieldlag behind. One of the reasons lies in normative logic itself, such as in its paradox orin its inconvincible system. Another reason lies in the fact that less attention has been paid to it. In fact, thestudy of normative logic is very important no matter in the view of logic itself or inthe view of the science of law. Normative logic takes law as its object language tostudy, while takes formal language as metalanguage to study the essential concept oflaw and legal norms and their inner relationship, so as to make the law an innerconsistent system and remove the contradiction. It becomes a new, analyzing tool forthe study of law. The article just tries hard to analyse the importance of normative logic to thestudy of law. The article is organized into five parts: The first part is a brief introduction to the development of normative logic. The second part is a summary of Von Wright’s one-place normativepropositional logic and analysis of some theorem of it from the science of law. The third is a summary of the standard one-place normative propositional logicand analysis of some theorem of it from the science of law. The fourth is a summary of Anderson’s normative propositional logic andanalysis of some theorem of it from the science of law. The last part is analysis of dyadic normative propositional logic from the scienceof law.
