公平形式掩蓋下的不公平——敦煌契約別議

【摘要】：一般認(rèn)為,契約相關(guān)的雙方(或多方)關(guān)系是平等的。但關(guān)系的平等,并不等于利害得失上的公平。本文通過對(duì)敦煌文獻(xiàn)S.6829V、S.6537V、P.3155V、P.3964等敦煌契約文書分析,發(fā)現(xiàn)其中就有一些很不公平的約定,筆者稱之為“公平形式掩蓋下的不公平”。
[Abstract]:It is generally believed that the relationship between the parties (or parties) involved in the contract is equal. But the equality of relations is not equal to the equity of gain and loss. Based on the analysis of Dunhuang contract documents such as Dunhuang document S.6829V / S.6537V / P.3155V/ P.3964, the author finds that there are some unfair agreements, which the author calls "unfairness under the cover of fair form".
