【摘要】：從出土的簡(jiǎn)牘材料可見,秦時(shí)已經(jīng)形成較為系統(tǒng)的學(xué)吏制度、官吏的任免與監(jiān)督制度。但在秦的官方行政文書及法律條文中,有不少將曾因某些不法行為而被免職或廢黜的官吏任用為“新地吏”的記載。秦將犯有過失的故秦吏選用為“新地吏”,與秦在擴(kuò)張過程中的行戍制度有關(guān)。這種做法實(shí)際是讓犯有過失的故秦吏以官吏身份到更偏遠(yuǎn)的“新地”行戍,戍期最多為四年,期滿后免官返回原籍。雖然這種做法與秦嚴(yán)苛的吏治精神有所抵牾,但卻是在秦統(tǒng)一初期針對(duì)“新地”官吏缺乏及統(tǒng)治不穩(wěn)的特殊情況下而采取的變通做法。
[Abstract]:As can be seen from the bamboo slips unearthed, Qin had formed a more systematic system of learning officials, appointment and removal of officials and supervision system. However, in the official administrative documents and legal provisions of Qin Dynasty, many officials who had been removed from office or deposed because of certain illegal acts were appointed as "New Land officials". Qin chose the misdemeanor as "New Land official", which was related to Qin's system of garrison in the process of expansion. In fact, the former Qin officials who had been guilty of negligence were allowed to go to the more remote "New Land" as officials and garrison for a maximum of four years, after which they were removed from office and returned to their places of origin. Although this practice contradicted the strict spirit of official administration in Qin Dynasty, it was an alternative approach in the early period of Qin Dynasty, which was aimed at the lack of officials in Xindi and the unstable rule.
