《岳麓書院藏秦簡（三）》相關(guān)問題研究

【摘要】：《岳麓書院藏秦簡(三)》“尸等捕盜疑購案”的郡報中購金額,皆為尸等逮捕一名罪犯的標準。該案治、閬等人皆為群盜盜殺人罪,但對其購賞的發(fā)放標準,因其秦人、荊人身份的不同而有差別。對秦人治等的賞金,以捕亡從群盜盜殺人的死罪標準發(fā)放,賞額為七兩。對荊人閬等的賞金,以非吏所興、毋什伍將長者捕它邦人來入為盜的標準發(fā)放,賞額為二兩�？笾械摹叭齼伞睘椤岸䞍伞敝`,這是文書書手經(jīng)常出現(xiàn)的錯誤�！棒哌^誤失坐官案”中“犯令”、“誤”、“坐官”三個法律術(shù)語,并不形成并列關(guān)系。因此,簡牘釋文中“小犯令二,大誤一,坐官、小誤五”的句讀方法有誤,當斷讀為“小犯令二、大誤一、坐官小誤五”。即八項糾劾可分為“小犯令”、“大誤”、“小誤”三類。其中“坐官”用來修飾“小誤”,表示足以引起連坐并追究責任的程度。“八劾”中第一、七兩個事例為小犯令行為,其余皆為誤。其中第八事例,在庫計中錯計弩百具,占據(jù)完整弩數(shù)比重較大,當為大誤。“學(xué)為偽書案”中“學(xué)”的行為,更類似于“盜書印”而非“為偽書”。如此方可解釋吏議中“耐為隸臣”與“贖耐”的兩種判決。不過其最終讞報中強調(diào)“毋擇已為卿”,又要求“謹窮法以論之”,或許郡級單位另有考慮,有從重處罰的可能。

The eight impeachment terms can be divided into three categories: minor offense order, big mistake and minor error. One of the "sitting officials" used to modify the "small mistake", indicating enough to cause the sitting and accountability. The first and seven cases of impeachment are minor crimes and the rest are false. In the eighth case, a hundred crossbows were counted incorrectly, which occupied a large proportion of the complete crossbows. The behavior of learning is more similar to the theft of books than to false books. Only in this way can the officials explain the two kinds of judgments of "tolerance for scribe" and "redemption tolerance". However, the final ruling newspaper stressed that "no choice has been made" and demanded that "the law of poverty should be discussed." perhaps the county units have considered otherwise, and there may be a possibility of heavier punishment.
