【摘要】：關(guān)于"政協(xié)憲草",臺灣學(xué)者承認(rèn)它的存在,認(rèn)為其是1946年憲法的藍(lán)本,而大陸學(xué)者對此并不認(rèn)同,甚至認(rèn)為所謂"政協(xié)憲草"是不存在的�？贾T史實(shí)可知,"政協(xié)憲草"是1946年2月至4月期間,由國民黨、中共、民主同盟、青年黨和無黨派方面的代表組成憲草審議委員會,修訂《五五憲草》過程中,形成的一份討論記錄稿。由于"政協(xié)憲草"只是一份記錄稿,因此當(dāng)初中共和民盟不承認(rèn)它具有憲法草案的性質(zhì)。但是,1946年底國民黨召開制憲國民大會時,又以"政協(xié)憲草"為底案制定了《中華民國憲法》。1946年以來,當(dāng)年憲審會的參加者先后公布過幾個不同版本的"政協(xié)憲草",但學(xué)界的研究只注意到其中一個,實(shí)際上還有三個。這些版本內(nèi)容具有一致性,和1946年憲法的精神也基本一致,但價值不同。應(yīng)特別重視其中的"《再生》版"和"陳啟天版",因?yàn)樗鼈儾攀瞧駷橹?政協(xié)憲草"最恰當(dāng)?shù)陌姹尽?br/>[Abstract]:As for the "constitution of the Chinese people's political Consultative Conference," Taiwan scholars acknowledge its existence as the blueprint of the 1946 constitution, but mainland scholars do not agree with it, and even believe that the so-called "constitution of the CPPCC" does not exist. From the historical facts, we can see that the "draft Constitution of the Chinese people's political Consultative Conference" was formed by representatives of the Kuomintang, the Communist Party of China, the Democratic League, the Al-Shabaab and non-party representatives from February to April 1946 in the process of revising the "May 5 Constitutional draft". Since the draft Constitution of the Chinese people's political Consultative Conference (CPPCC) was only a draft, the Chinese Communist Party and the NLD did not recognize it as a draft constitution. However, when the Kuomintang convened its Constituent National Convention at the end of 1946, it formulated the "Constitution of the Republic of China" on the basis of the "Constitution of the CPPCC". The participants of the Constitutional Review Committee published several different versions of the "Constitution of the Chinese people's political Consultative Conference", but academic research only noticed one of them, and in fact there were three. These versions are consistent, basically consistent with the spirit of the 1946 Constitution, but of different value. Special attention should be paid to "Regeneration" and "Chen Qitian", as they are the most appropriate version of the "constitution of the Chinese people's political Consultative Conference" so far.
