【摘要】：在中國(guó)傳統(tǒng)契約的發(fā)展史上,出現(xiàn)了一個(gè)從券書(shū)(竹木契約)到契紙(紙質(zhì)契約)的重大形制變化。物質(zhì)載體的根本性轉(zhuǎn)變,還伴隨著契約書(shū)寫(xiě)形式的明顯變化。由于紙契具有獨(dú)特的征信功能,無(wú)須采取券書(shū)合驗(yàn)的方式,唐代以后絕大多數(shù)的契約為單契,其中賣(mài)契又占據(jù)主流地位。這部分歸因于契約雙方經(jīng)濟(jì)地位的不對(duì)等,另外,唐代的土地交易法令也對(duì)賣(mài)契形式的確立起到重要作用。考察中國(guó)傳統(tǒng)契約的形制變化,有助于避免以西方契約理論盲目套用于傳統(tǒng)契約的不當(dāng)做法。
[Abstract]:In the history of the development of Chinese traditional contract, there has been a great change in form from voucher (bamboo contract) to paper contract (paper contract). The fundamental change of material carrier is accompanied by obvious changes in the form of contract writing. Because the paper deed has the unique function of credit investigation, it does not need to adopt the method of certificate book and check. After the Tang Dynasty, most of the contracts are single deed, among which the selling contract occupies the mainstream position. This is partly due to the unequal economic status of both parties to the contract, in addition, the land transaction law of the Tang Dynasty also played an important role in establishing the form of the lease of sale. It is helpful to avoid the improper practice of applying the western contract theory blindly to the traditional contract.
