【摘要】：百年來(lái)出土、發(fā)現(xiàn)的出土簡(jiǎn)牘法律文獻(xiàn),數(shù)量眾多,類別豐富,因而從文獻(xiàn)學(xué)、法律史學(xué)的視角辨析其定名、性質(zhì)、類別的必要性毋庸贅言。就定名而言,律令類簡(jiǎn)牘或可不從"文書(shū)"之類,而當(dāng)歸入書(shū)籍并作為獨(dú)立門類。就性質(zhì)而言,應(yīng)辨析墓葬出土法律文獻(xiàn)抄本與原本的關(guān)系,追問(wèn)"為何抄寫"、"如何抄寫",將有助于對(duì)文獻(xiàn)的產(chǎn)生、性質(zhì)、流播的判斷。簡(jiǎn)牘法律文獻(xiàn)的大致類別,有律、令、課程品式、法律解釋、案例匯編、散見(jiàn)案件、司法檔案、司法文書(shū)及官箴吏訓(xùn)。類別之明,可透視當(dāng)時(shí)法律文獻(xiàn)的生成途徑。
[Abstract]:In the past hundred years, the unearthed bamboo slips of legal documents have been found in numerous quantities and in rich categories. Therefore, the necessity of identifying their names, nature and categories from the perspectives of philology and legal history does not need to be repeated. The legal texts may be classified as books and as separate categories instead of "documents". In nature, the relationship between the transcripts of the legal documents unearthed from tombs and the original should be distinguished. Asking "Why to copy" and "how to copy" will help to judge the production, nature, and stream of documents. The general categories, rules, orders, curriculum style, interpretation of laws, compilation of cases, scattered cases, judicial files, etc. Judicial documents and official admonitions. The categories can see through the generation of legal documents at that time.
