【摘要】：岳麓秦簡(jiǎn)《金布律》詳細(xì)規(guī)定了秦代奴婢、馬牛的買賣程序及相應(yīng)違規(guī)行為的懲罰措施。律文顯示,質(zhì)是秦漢時(shí)期進(jìn)行奴婢、馬牛等大型交易時(shí)簽訂的買賣契券,質(zhì)錢則是在市亭立券時(shí)買賣雙方交給官方之錢。但質(zhì)錢并不同于契稅,其性質(zhì)更接近官府為買賣進(jìn)行擔(dān)保而收取的傭金。在奴婢、馬牛的外地買賣中,出賣方必須事先申請(qǐng)由縣級(jí)長(zhǎng)官簽發(fā)的傳,做為通關(guān)以及簽訂買賣契券時(shí)證明擁有合法所有權(quán)的憑證。用致通關(guān)只適用于購(gòu)買方,由于申請(qǐng)傳的程序相對(duì)復(fù)雜,故而允許由管理交易的官吏出具致書,證明其攜帶的馬牛、奴婢屬合法購(gòu)得,而準(zhǔn)許通行。致并非專用的通關(guān)文書,只是有關(guān)部門向關(guān)津說(shuō)明情況的通報(bào)。
[Abstract]:Yuelu Qin slips "Jinbu Law" specifies in detail the procedures for buying and selling slaves, horse cattle and the corresponding punishment measures for illegal activities in the Qin Dynasty. The law shows that quality is the deed of deed signed in the period of Qin and Han dynasties when the slave maidservant and horse cattle were engaged in large-scale transactions, such as the purchase and sale of coupons. The pledge money is the money given to the official by both the buyer and the seller when the market kiosk is set up. However, the pledge money is not the same as the deed tax, but its nature is closer to the commission received by the government for the purpose of guaranteeing the transaction. In the foreign trade of the slave maidservant, Ma Niu, The seller must apply for a transmission issued by the county governor in advance as a certificate of legal ownership at the time of the customs clearance and the signing of the deed of purchase and sale. The clearance only applies to the buyer, as the procedure for application and transmission is relatively complex. Therefore, the official who manages the transaction is allowed to issue a letter certifying that the horse cattle and maidservant they carry are legally purchased, and that they are permitted to pass through. It is not a special customs document, but a notification from the relevant department explaining the situation to Guan Jin.
