【摘要】：傳統(tǒng)中國(guó)的統(tǒng)治者試圖建構(gòu)一套關(guān)于土地權(quán)力支配的正當(dāng)性結(jié)構(gòu),然而這種正當(dāng)性建構(gòu)的努力卻總是無(wú)法阻止土地權(quán)力的擴(kuò)張與"異化"。這種"異化"具體表現(xiàn)為官方的"苛捐雜稅征用無(wú)度"以及由此映射到民間之后有權(quán)者"大肆兼并"與無(wú)權(quán)者"以田多為累"的對(duì)立統(tǒng)一。從根本上講,土地權(quán)力的"異化"是傳統(tǒng)社會(huì)權(quán)制邏輯下的必然現(xiàn)象,而其匡正與消弭則寓于國(guó)家治理從傳統(tǒng)向現(xiàn)代的整體轉(zhuǎn)換當(dāng)中。
[Abstract]:The rulers of traditional China try to construct a set of legitimate structure about the domination of land power, but the efforts of this kind of legitimacy construction can never stop the expansion and "alienation" of land power. This kind of "alienation" is embodied in the official "exorbitant tax expropriation" and the unity of opposites of "wantonly merger" and "tiredness" between the powerful and the powerless after it is mapped to the private people. Fundamentally speaking, the "alienation" of land power is an inevitable phenomenon under the logic of traditional social power system, and its correction and elimination lie in the overall transformation of national governance from traditional to modern.
