【摘要】：監(jiān)督“一府兩院”的工作是人大及其常委會(huì)的一項(xiàng)重要職權(quán)。這種監(jiān)督,既是一種制約,又是支持和促進(jìn)。在我國(guó)政治生活中,憲法和法律賦予人大“權(quán)重位尊”的地位。按理說(shuō),由這樣權(quán)威機(jī)關(guān)實(shí)施的監(jiān)督,應(yīng)該是根本制度的監(jiān)督、是國(guó)家最高層次的監(jiān)督、是最具權(quán)威的監(jiān)督,居于核心地位,具有最高的法律效力。但從地方人大近年的實(shí)踐來(lái)看,人大監(jiān)督工作仍然是處于一個(gè)“弱勢(shì)”地位,監(jiān)督職能發(fā)揮不到位,監(jiān)督效果不明顯的問(wèn)題仍然比較突出。 本文首先明確了人大監(jiān)督的有關(guān)概念,并對(duì)人大監(jiān)督的屬性和作用進(jìn)行了簡(jiǎn)要概述,同時(shí)對(duì)人大監(jiān)督的對(duì)象和內(nèi)容、程序和方式以及監(jiān)督的結(jié)果等作了簡(jiǎn)要介紹。在此基礎(chǔ)上,運(yùn)用文獻(xiàn)分析法、實(shí)證分析法以及比較分析法分析了盤(pán)山縣人大監(jiān)督的實(shí)踐現(xiàn)狀,并就盤(pán)山縣人大監(jiān)督的方式和內(nèi)容、監(jiān)督的方式和成果等要素進(jìn)行了深入闡述,進(jìn)而指出當(dāng)前盤(pán)山縣人大監(jiān)督存在的諸如“監(jiān)督主體不具體,監(jiān)督對(duì)象不明確,監(jiān)督手段單一及代表素質(zhì)欠缺”等問(wèn)題。通過(guò)對(duì)盤(pán)山縣人大實(shí)際情況的分析,找出盤(pán)山縣人大監(jiān)督出現(xiàn)上述問(wèn)題在思想、體制、制度、現(xiàn)實(shí)等方面原因,根據(jù)盤(pán)山縣人大存在的問(wèn)題及原因分析,提出了“積極培育憲法意識(shí)、深化和完善相關(guān)體制、加強(qiáng)法制建設(shè)”等強(qiáng)化盤(pán)山縣人大監(jiān)督的對(duì)策思路。 論文用五章詳細(xì)說(shuō)明了提升盤(pán)山縣人大監(jiān)督力度的對(duì)策研究,并在第三章中,專(zhuān)門(mén)撰寫(xiě)了提升盤(pán)山縣人大監(jiān)督力度的方案論證,使文章提出的對(duì)策建議更加具有操作性和實(shí)踐性,能在實(shí)際中解決盤(pán)山縣人大監(jiān)督工作中存在的問(wèn)題,從理論和實(shí)踐的角度對(duì)盤(pán)山縣人大監(jiān)督工作提供解決之法。
[Abstract]:Supervising the work of "one government and two courts" is an important function of the people's Congress and its standing Committee. This kind of supervision, is a kind of restriction, is also supports and promotes. In the political life of our country, the constitution and law endow the people's Congress with the status of "weight and honor". It is reasonable to say that the supervision carried out by such authoritative organs should be the supervision of the fundamental system, the highest level of supervision by the state and the most authoritative supervision, which occupies the core position and has the highest legal effect. But from the practice of the local people's Congress in recent years, the supervision work of the people's Congress is still in a "weak" position, the supervisory function is not in place, and the effect of supervision is still relatively prominent. In this paper, the concept of NPC supervision is defined, and the attributes and functions of NPC supervision are briefly summarized. At the same time, the object and content, procedure and method of NPC supervision as well as the results of supervision are briefly introduced. On this basis, the paper analyzes the practical situation of Panshan County people's Congress Supervision by using literature analysis, empirical analysis and comparative analysis, and expounds in depth the methods and contents of Panshan County people's Congress Supervision, the ways and results of supervision, and so on. Then points out that the current Panshan County people's Congress supervision problems such as "the main body of supervision is not specific, the object of supervision is not clear, supervision means are single and lack of representative quality" and so on. By analyzing the actual situation of Panshan County people's Congress, we find out the reasons for the above problems in the ideology, system, reality and so on. According to the existing problems and reasons of Panshan County people's Congress, This paper puts forward some countermeasures to strengthen the supervision of Panshan County's people's Congress, such as "actively cultivating the consciousness of constitution, deepening and perfecting the relevant system and strengthening the construction of legal system". The paper uses five chapters to explain in detail the countermeasures to improve the supervision of Panshan County people's Congress, and in the third chapter, it specially writes the scheme demonstration of improving the supervision intensity of Panshan County people's Congress. The countermeasures and suggestions put forward in this paper are more operable and practical, which can solve the problems existing in the supervision work of Panshan County people's Congress in practice, and provide a way to solve the supervision work of Panshan County people's Congress from the angle of theory and practice.
