【摘要】：全國(guó)人大常委會(huì)的"試點(diǎn)授權(quán)"為改革試點(diǎn)突破現(xiàn)行規(guī)定提供了法律依據(jù),成為了"重大改革于法有據(jù)"的示范性舉措;然而,其示范意義不應(yīng)流于為相關(guān)改革提供形式依據(jù),其內(nèi)容自身首先應(yīng)符合法律規(guī)定及其所蘊(yùn)含的法律原理。衡量"試點(diǎn)授權(quán)"是否實(shí)質(zhì)性"于法有據(jù)",可從四類要素分析:從權(quán)限要素看,"試點(diǎn)授權(quán)"應(yīng)限于非憲法保留事項(xiàng)和常委會(huì)自身有立法權(quán)限的事項(xiàng);從時(shí)間要素看,應(yīng)先于試點(diǎn)改革而作出,并符合授權(quán)期限;從后果要素看,"試點(diǎn)授權(quán)"到期之后根據(jù)試點(diǎn)情況而發(fā)生試點(diǎn)推廣、變更或延長(zhǎng)等不同法律后果;空間要素上,授權(quán)空間在范圍上具有部分性以及與授權(quán)事項(xiàng)的關(guān)聯(lián)性。
[Abstract]:The "pilot authorization" of the standing Committee of the National people's Congress provides the legal basis for the reform to break through the existing regulations, and has become an exemplary measure of "major reform on the basis of law". However, its demonstrative significance should not be a formal basis for the relevant reform, and its content itself should first accord with the legal provisions and the legal principles contained therein. To measure whether the "pilot authorization" is substantial "according to the law" can be analyzed from four kinds of elements: from the view of the competence factor, the "pilot authorization" should be limited to the non-constitutional reservation and the matters with the standing Committee's own legislative competence; From the point of view of the time factor, it should be made before the pilot reform and accord with the period of authorization; from the point of view of the consequence factor, different legal consequences such as extension, modification or extension of the pilot should occur according to the situation of the pilot project after the expiration of the "pilot authorization"; In the space element, the authorization space has the partial character in the scope and the correlation with the authorization item.
