街區(qū)制實(shí)施過程中的利益沖突與化解路徑

【摘要】:2016年初,我國(guó)決定在城市規(guī)劃建設(shè)管理中推廣街區(qū)制,并逐步開放封閉小區(qū)。開放和包容是街區(qū)制的特點(diǎn),可以實(shí)現(xiàn)資源的整合,促進(jìn)社區(qū)居民的融合,但小區(qū)開放后,社區(qū)私有空間轉(zhuǎn)變社會(huì)公共空間,影響了業(yè)主的物權(quán)和生活質(zhì)量,社區(qū)安全隱患突顯,增加了小區(qū)管理的復(fù)雜性,給小區(qū)管理者帶來壓力。因此,這一政策的出臺(tái)給城市社區(qū)一直奉行的封閉社區(qū)的生活管理模式帶來巨大的沖擊,一時(shí)間成為公眾關(guān)注的熱點(diǎn),爭(zhēng)議不斷。問卷調(diào)查也顯示,居民較了解開放小區(qū)政策,但近一半人反對(duì)開放小區(qū)。究其根源,街區(qū)制的實(shí)施過程是一個(gè)公私利益博弈的過程,小區(qū)的開放觸及了多個(gè)主體的利益。作為街區(qū)制利益沖突的最直接主體——小區(qū)業(yè)主比較關(guān)注:物權(quán)變動(dòng)帶來的利益損失;開放后帶來的社區(qū)安全;影響日常生活質(zhì)量等問題。同時(shí),開放小區(qū)也增加了小區(qū)管理部門的管理難度。因此,推行街區(qū)制,必須處理好與各個(gè)利益主體的關(guān)系,包括政府部門、小區(qū)業(yè)主、物業(yè)管理公司、開發(fā)商、居委會(huì)、業(yè)委會(huì)以及外部人員等。論文以利益沖突和社會(huì)整合理論為基礎(chǔ),在梳理城市管理體系發(fā)展脈絡(luò)的基礎(chǔ)上,探討街區(qū)制推行過程中公私利益沖突的表現(xiàn)和特點(diǎn),并借鑒國(guó)內(nèi)外街區(qū)制推行的經(jīng)驗(yàn),從制度建構(gòu)、管理策略和技術(shù)支持等三個(gè)層面探討化解利益沖突的路徑,以期能為今后應(yīng)對(duì)街區(qū)制推行過程可能出現(xiàn)的沖突和風(fēng)險(xiǎn)提供參考和借鑒,推動(dòng)街區(qū)制的落實(shí),促進(jìn)城市的和諧發(fā)展。
[Abstract]:In early 2016, China decided to promote block system in urban planning and construction management, and gradually open closed community. Opening and inclusiveness are the characteristics of block system, which can realize the integration of resources and promote the integration of community residents. However, after the opening of the community, the private space of the community changes the social public space, which affects the owner's real right and the quality of life. The hidden danger of community safety has increased the complexity of community management and brought pressure to community managers. Therefore, the introduction of this policy has brought a huge impact on the life management mode of closed communities, which has always been pursued by urban communities, and has become a hot spot of public concern for a time. The survey also showed that residents are more aware of the open community policy, but nearly half are opposed to it. The implementation process of block system is a process of public and private interest game, and the opening of community touches the interests of many subjects. As the most direct subject of the conflict of interest in the district system, the owners of the residential district pay more attention to the following problems: the loss of interests brought by the change of real right; the community safety after the opening up; the impact on the quality of daily life and so on. At the same time, open community also increases the management difficulty of district management department. Therefore, to carry out the block system, we must deal with the relationship with various stakeholders, including government departments, community owners, property management companies, developers, neighborhood committees, industry committees and external personnel. Based on the theory of conflict of interest and social integration and combing the development of urban management system, this paper discusses the manifestation and characteristics of the conflict of public and private interests in the implementation of the district system, and draws lessons from the experience of the implementation of the district system at home and abroad. From three aspects of system construction, management strategy and technical support, this paper discusses the ways to resolve conflicts of interest, in order to provide reference and reference for the possible conflicts and risks in the implementation of block system in the future, and to promote the implementation of district system. Promote the harmonious development of the city.
