【摘要】：較傳統(tǒng)家庭而言,現(xiàn)代家庭形態(tài)已發(fā)生根本性變革,前者強(qiáng)調(diào)權(quán)力發(fā)揮,后者強(qiáng)調(diào)權(quán)利保障。現(xiàn)代社會(huì)家庭已成為個(gè)人權(quán)利的實(shí)現(xiàn)形式,其遵循一種"家庭即個(gè)人"的邏輯,而不再是"個(gè)人即家庭"的依附關(guān)系。公有制與家庭實(shí)質(zhì)上形成手段與目的的關(guān)系,公有制作為協(xié)調(diào)社會(huì)所有與個(gè)人占有模式的手段,"家庭即個(gè)人"的邏輯最終讓家庭占有成為個(gè)人占有的一種模式,家庭受益成為最終目的。家庭自治是社會(huì)治理模式的縮影,而現(xiàn)代社會(huì)治理需要尋求家庭自治的完善。在當(dāng)今時(shí)代背景下,我國(guó)應(yīng)以家庭法律化為路徑促進(jìn)實(shí)現(xiàn)社會(huì)治理。
[Abstract]:Compared with the traditional family, the modern family has undergone fundamental changes. The former emphasizes the exertion of power, the latter emphasizes the protection of rights. In modern society, family has become the realization form of individual rights, which follows the logic of "family as individual", and no longer is the dependence of "individual as family". The public ownership and the family form the relationship between the means and the ends in essence. As the means to coordinate the mode of social ownership and individual possession, the logic of "family is the individual" finally makes the family occupation a mode of individual possession. Family benefits become the ultimate goal. Family autonomy is the epitome of social governance model, and modern social governance needs to seek the perfection of family autonomy. Under the background of the present age, our country should take the family law as the path to promote the realization of social governance.
